Motive for Assault on KontraS Activist Suspected to Be Personal Vendetta
Jakarta (ANTARA) - The Head of Military Prosecutor II-07 Jakarta, Colonel Chk Andri Wijaya, has revealed that the motive behind the four defendants, who are TNI soldiers in the alleged assault case against KontraS activist Andrie Yunus, is suspected to point towards a personal vendetta.
“For the motive, up to this point, what we have delved into through the Examination Report (BAP) is that the motive carried out by the defendants is still a personal grudge against brother AY,” said Andri after handing over the case file and evidence in the alleged assault case against KontraS activist Andrie Yunus to the Military Court II-08 Jakarta on Thursday.
Nevertheless, Andri emphasised that this motive is not yet fully final and will be further examined during the trial process at the Military Court II-08 Jakarta.
Furthermore, he also acknowledged a connection between this personal vendetta motive and a previous incident involving the victim.
The incident in question occurred when Andrie Yunus forced his way into a closed meeting discussing the revision of the TNI Law at a hotel in Jakarta in 2025.
“Yes, there is, but for more details, we can see and hear the proof during the trial later,” said Andri.
Regarding the ongoing legal process, he assured that his side has completed the investigation stage and has transferred the case file along with evidence to the Military Court II-08 Jakarta.
With this transfer, the authority to handle the case has officially shifted from the military prosecutor to the court.
“In this case, the case file has already been transferred to the Military Court II-08 Jakarta, so our authority has shifted,” said Andri.
“However, if during the trial proof there are additions or otherwise, further investigation will still be conducted,” explained Andri.
He also responded to allegations from several parties, including a civil society coalition, which claimed that the number of perpetrators in the case could be more than four, even reaching a dozen.
According to Andri, such allegations greatly depend on the facts revealed during the trial.
In that scenario, he said, if other parties are found to be involved, including from civilian circles, the case handling will be done separately, in accordance with the applicable legal mechanisms.
“If there is a civilian suspect, it will be split or separated. So, this is in accordance with the procedural law and the standard operating procedure (SOP) of the Supreme Court of the Republic of Indonesia; we must still carry it out accordingly,” said Andri.
This statement underscores that the legal process will proceed according to the established corridors, including the separation of handling between military and civilian perpetrators.
“Based on that, we are considering Wednesday. Therefore, for now, we have scheduled the first trial for Wednesday, 29 April 2026,” said the Head of Military Court II-08 Jakarta, Colonel Chk Fredy Ferdian Isnartanto, after the handover of the case file and evidence in the alleged assault case against KontraS activist Andrie Yunus to the Military Court II-08 Jakarta on Thursday.
That first hearing, he said, will agenda the reading of the indictment against the defendants who are active military members.
He mentioned that the trial scheduling was done after his side received and examined the case file transferred by the Military Prosecutor II-07 Jakarta.
In that first hearing, the defendants are assured to be present directly in the courtroom. Their presence is mandatory as part of the process of reading the indictment by the military prosecutor.
The Military Court II-08 Jakarta also ensures that the trial process will be open to the public. The public, including media circles, is invited to follow the course of the trial to ensure the transparency of the legal process.
Previously, the Military Court II-08 Jakarta officially received the case file for the alleged assault against KontraS activist Andrie Yunus from the Military Prosecutor II-07 Jakarta on Thursday.
After the case file was received, the next stage is the appointment of the panel of judges who will examine and adjudicate the case.
All four previously held suspect status and now officially become defendants after the case file was transferred to the court.
The case is registered under number 55/K/207/AL-AU/IV/2026 dated 13 April 2026. The file includes evidence, four defendants, and eight witnesses who will be presented at the trial.
Of the eight witnesses, five are military members, while the other three are from civilian circles.
In the construction of the indictment, the Military Prosecutor applies a layered or subsidiary indictment system against the defendants. For the primary charge, the defendants are charged under Article 469 paragraph (1) of the Criminal Code Jo Article 20 letter C of Law Number 1 of 2023 with a maximum penalty of 12 years’ imprisonment.
Next, the subsidiary charge is imposed under Article 448 paragraph (1) juncto Article 20 letter C of Law Number 1 of 2023 with a maximum penalty of eight years’ imprisonment.
Meanwhile, the further subsidiary charge uses Article 467 paragraph (1) and paragraph (2) juncto Article 20 letter C of Law Number 1 of 2023 with a maximum sentence of seven years’ imprisonment.
In addition to the case file, the Military Prosecutor II-07 Jakarta also handed over 11 pieces of evidence related to the alleged assault case against KontraS activist Andrie Yunus to the Military Court II-08 Jakarta on Thursday.
The evidence handed over includes one tumbler glass, one pair of glasses, one white T-shirt, one pair of shoes, one pair of trousers, one shirt, one black helmet along with its padding, one flash drive containing video, one used battery bottle, one bottle of rust cleaner residue, and two motorcycles.
