Jakarta (ANTARA) - The Head of Military Prosecutor II-07 Jakarta,\nColonel Chk Andri Wijaya, has revealed that the motive behind the four\ndefendants, who are TNI soldiers in the alleged assault case against\nKontraS activist Andrie Yunus, is suspected to point towards a personal\nvendetta.<\/p>\n
\u201cFor the motive, up to this point, what we have delved into through\nthe Examination Report (BAP) is that the motive carried out by the\ndefendants is still a personal grudge against brother AY,\u201d said Andri\nafter handing over the case file and evidence in the alleged assault\ncase against KontraS activist Andrie Yunus to the Military Court II-08\nJakarta on Thursday.<\/p>\n
Nevertheless, Andri emphasised that this motive is not yet fully\nfinal and will be further examined during the trial process at the\nMilitary Court II-08 Jakarta.<\/p>\n
Furthermore, he also acknowledged a connection between this personal\nvendetta motive and a previous incident involving the victim.<\/p>\n
The incident in question occurred when Andrie Yunus forced his way\ninto a closed meeting discussing the revision of the TNI Law at a hotel\nin Jakarta in 2025.<\/p>\n
\u201cYes, there is, but for more details, we can see and hear the proof\nduring the trial later,\u201d said Andri.<\/p>\n
Regarding the ongoing legal process, he assured that his side has\ncompleted the investigation stage and has transferred the case file\nalong with evidence to the Military Court II-08 Jakarta.<\/p>\n
With this transfer, the authority to handle the case has officially\nshifted from the military prosecutor to the court.<\/p>\n
\u201cIn this case, the case file has already been transferred to the\nMilitary Court II-08 Jakarta, so our authority has shifted,\u201d said\nAndri.<\/p>\n
\u201cHowever, if during the trial proof there are additions or otherwise,\nfurther investigation will still be conducted,\u201d explained Andri.<\/p>\n
He also responded to allegations from several parties, including a\ncivil society coalition, which claimed that the number of perpetrators\nin the case could be more than four, even reaching a dozen.<\/p>\n
According to Andri, such allegations greatly depend on the facts\nrevealed during the trial.<\/p>\n
In that scenario, he said, if other parties are found to be involved,\nincluding from civilian circles, the case handling will be done\nseparately, in accordance with the applicable legal mechanisms.<\/p>\n
\u201cIf there is a civilian suspect, it will be split or separated. So,\nthis is in accordance with the procedural law and the standard operating\nprocedure (SOP) of the Supreme Court of the Republic of Indonesia; we\nmust still carry it out accordingly,\u201d said Andri.<\/p>\n
This statement underscores that the legal process will proceed\naccording to the established corridors, including the separation of\nhandling between military and civilian perpetrators.<\/p>\n
\u201cBased on that, we are considering Wednesday. Therefore, for now, we\nhave scheduled the first trial for Wednesday, 29 April 2026,\u201d said the\nHead of Military Court II-08 Jakarta, Colonel Chk Fredy Ferdian\nIsnartanto, after the handover of the case file and evidence in the\nalleged assault case against KontraS activist Andrie Yunus to the\nMilitary Court II-08 Jakarta on Thursday.<\/p>\n
That first hearing, he said, will agenda the reading of the\nindictment against the defendants who are active military members.<\/p>\n
He mentioned that the trial scheduling was done after his side\nreceived and examined the case file transferred by the Military\nProsecutor II-07 Jakarta.<\/p>\n
In that first hearing, the defendants are assured to be present\ndirectly in the courtroom. Their presence is mandatory as part of the\nprocess of reading the indictment by the military prosecutor.<\/p>\n
The Military Court II-08 Jakarta also ensures that the trial process\nwill be open to the public. The public, including media circles, is\ninvited to follow the course of the trial to ensure the transparency of\nthe legal process.<\/p>\n
Previously, the Military Court II-08 Jakarta officially received the\ncase file for the alleged assault against KontraS activist Andrie Yunus\nfrom the Military Prosecutor II-07 Jakarta on Thursday.<\/p>\n
After the case file was received, the next stage is the appointment\nof the panel of judges who will examine and adjudicate the case.<\/p>\n
All four previously held suspect status and now officially become\ndefendants after the case file was transferred to the court.<\/p>\n
The case is registered under number 55\/K\/207\/AL-AU\/IV\/2026 dated 13\nApril 2026. The file includes evidence, four defendants, and eight\nwitnesses who will be presented at the trial.<\/p>\n
Of the eight witnesses, five are military members, while the other\nthree are from civilian circles.<\/p>\n
In the construction of the indictment, the Military Prosecutor\napplies a layered or subsidiary indictment system against the\ndefendants. For the primary charge, the defendants are charged under\nArticle 469 paragraph (1) of the Criminal Code Jo Article 20 letter C of\nLaw Number 1 of 2023 with a maximum penalty of 12 years\u2019\nimprisonment.<\/p>\n
Next, the subsidiary charge is imposed under Article 448 paragraph\n(1) juncto Article 20 letter C of Law Number 1 of 2023 with a maximum\npenalty of eight years\u2019 imprisonment.<\/p>\n
Meanwhile, the further subsidiary charge uses Article 467 paragraph\n(1) and paragraph (2) juncto Article 20 letter C of Law Number 1 of 2023\nwith a maximum sentence of seven years\u2019 imprisonment.<\/p>\n
In addition to the case file, the Military Prosecutor II-07 Jakarta\nalso handed over 11 pieces of evidence related to the alleged assault\ncase against KontraS activist Andrie Yunus to the Military Court II-08\nJakarta on Thursday.<\/p>\n
