MKMK Chairman Refuses to Disclose Adies Kadir Report to Parliament: 'Better to Dismiss Me'
The Chairman of the Constitutional Court's Honour Council (MKMK), I Gede Dewa Palguna, refused to disclose details of the complaint against Constitutional Court Justice Adies Kadir when pressed by members of the House of Representatives during a Commission III hearing. Palguna insisted he would rather be dismissed than reveal the contents of the report.
Palguna made the remarks during a meeting with Commission III at the parliamentary complex in Senayan, Jakarta, on Wednesday (18 February 2026). Several Commission III members had initially requested that Palguna elaborate on the examination process concerning the complaint against Justice Adies Kadir, which was filed on behalf of the DPR.
Palguna firmly stated he could not divulge such information, emphasising that doing so would violate his oath of office.
"As far as the substance of what we are handling is concerned, ladies and gentlemen, we cannot disclose it here. It is simply not possible. Because we would be violating our oath and we would be violating procedural law," Palguna said during the hearing.
Palguna then addressed one Commission III member who had described his presentation regarding the Adies Kadir complaint as overly normative. He affirmed that he could not reveal the substance of the report and stated he would prefer to be dismissed.
"So if what was requested here — if you are asking us about our report, which you say is too normative, and what is happening with the Adies Kadir process — we simply cannot convey that, sir. That is our independence. If that is what you are demanding, I would rather request to be dismissed from the Honour Council. Seriously. Because that is the crown jewel of the Honour Council, sir," he said.
Furthermore, he stated that no one outside the three MKMK judges is aware of the substance of developments in the complaint against Adies Kadir. He therefore urged all parties to await the MKMK's decision.
"We cannot present it before other people because the three of us must keep it confidential — even our staff do not know when we are about to make a decision. This includes the stance on whether to proceed or not. This is still at the preliminary examination stage, sir," he explained.
Palguna reiterated that the MKMK would not reveal its position on the complaint against Adies Kadir. He once again stated he would request dismissal from the MKMK if forced to disclose the substance of the report.
"However, if whilst we are conducting the preliminary examination, ladies and gentlemen are already asking what the Honour Council's position will be — we cannot convey that. As I have said, if we were to disclose it, I would rather be dismissed as a member of the Honour Council," he affirmed.
