The Chairman of the Constitutional Court\u2019s Honour Council (MKMK), I\nGede Dewa Palguna, refused to disclose details of the complaint against\nConstitutional Court Justice Adies Kadir when pressed by members of the\nHouse of Representatives during a Commission III hearing. Palguna\ninsisted he would rather be dismissed than reveal the contents of the\nreport.<\/p>\n
Palguna made the remarks during a meeting with Commission III at the\nparliamentary complex in Senayan, Jakarta, on Wednesday (18 February\n2026). Several Commission III members had initially requested that\nPalguna elaborate on the examination process concerning the complaint\nagainst Justice Adies Kadir, which was filed on behalf of the DPR.<\/p>\n
Palguna firmly stated he could not divulge such information,\nemphasising that doing so would violate his oath of office.<\/p>\n
\u201cAs far as the substance of what we are handling is concerned, ladies\nand gentlemen, we cannot disclose it here. It is simply not possible.\nBecause we would be violating our oath and we would be violating\nprocedural law,\u201d Palguna said during the hearing.<\/p>\n
Palguna then addressed one Commission III member who had described\nhis presentation regarding the Adies Kadir complaint as overly\nnormative. He affirmed that he could not reveal the substance of the\nreport and stated he would prefer to be dismissed.<\/p>\n
\u201cSo if what was requested here \u2014 if you are asking us about our\nreport, which you say is too normative, and what is happening with the\nAdies Kadir process \u2014 we simply cannot convey that, sir. That is our\nindependence. If that is what you are demanding, I would rather request\nto be dismissed from the Honour Council. Seriously. Because that is the\ncrown jewel of the Honour Council, sir,\u201d he said.<\/p>\n
Furthermore, he stated that no one outside the three MKMK judges is\naware of the substance of developments in the complaint against Adies\nKadir. He therefore urged all parties to await the MKMK\u2019s decision.<\/p>\n
\u201cWe cannot present it before other people because the three of us\nmust keep it confidential \u2014 even our staff do not know when we are about\nto make a decision. This includes the stance on whether to proceed or\nnot. This is still at the preliminary examination stage, sir,\u201d he\nexplained.<\/p>\n
Palguna reiterated that the MKMK would not reveal its position on the\ncomplaint against Adies Kadir. He once again stated he would request\ndismissal from the MKMK if forced to disclose the substance of the\nreport.<\/p>\n
\u201cHowever, if whilst we are conducting the preliminary examination,\nladies and gentlemen are already asking what the Honour Council\u2019s\nposition will be \u2014 we cannot convey that.
