Constitutional Court hears testimony from DPR and President on material review of Police Law
Jakarta (ANTARA) - The Constitutional Court (MK) on Wednesday held a continuation hearing for the material review of Law No. 2 of 2002 on the National Police (Polri), with the agenda of hearing testimonies from the DPR and the President.
The hearing, which commenced at 13:30 WIB, was chaired by MK Chief Justice Suhartoyo and attended by eight other constitutional justices. It featured legal representatives from the DPR and the President.
The DPR assigned Hinca Ikara Putra Panjaitan from Commission III to deliver the testimony. The President was represented by two parties: from the Ministry of Law and Human Rights, attended by Deputy Minister Edward Omar Sharif Hiariej, and from Polri, attended by the Head of the Legal Division of Polri Headquarters, Inspector General of Police Agus Nugroho.
The material review of Law No. 2 of 2002 on Polri is registered under case number 63/PUU-XXIV/2026, requested by advocates Christian Andrianus Sihite, Syamsul Jahidin, and Edy Rudyanto. They are challenging Article 8 paragraph (1) and Article 8 paragraph (2) of the Polri Law, primarily seeking to place Polri under the Ministry of Home Affairs (Kemendagri).
The case, registered in February 2026, had its preliminary hearing on 19 February 2026.
In their petition, the applicants request that the MK declare Article 8 paragraph (1) of the Polri Law contrary to the 1945 Constitution of the Republic of Indonesia and devoid of binding legal force.
The petitioners argue that Polri’s direct placement under the President has the potential for discrimination, particularly against advocates defending the opposition or those opposing the government, who would be treated differently from advocates supporting the government.
The testimony from the DPR’s legal representative was delivered by Hinca Panjaitan virtually, while Deputy Minister of Law Eddy Hiariej and Polri’s Head of Legal Division Inspector General of Police Agus Nugroho attended in person at the courtroom. The testimony from the President’s legal representatives was presented by Deputy Minister of Law Eddy Hiariej.
