Wiretapping Bill to Regulate Notification to Citizens Who Have Been Wiretapped
JAKARTA - The House of Representatives Expert Body has revealed that the Wiretapping Bill will regulate notifications to citizens who have been subjected to wiretapping.
The DPR Expert Body proposes this mechanism as post-factum notification, namely informing individuals who were once the subject of wiretapping after the legal process is complete and they are not proven guilty.
“Individuals who were once the subject of wiretapping but are later proven not guilty have the right to be notified after the investigation or inquiry process is complete,” said the Head of the DPR RI Expert Body, Bayu Dwi Anggono, during a working meeting discussing the development of the Wiretapping Bill with the DPR Legislation Body at the RI Parliamentary Complex, Jakarta, on Thursday (2/4/2026).
Without clear regulations, citizens’ personal data could be misused or stored indefinitely by law enforcement agencies.
“So on one hand, although efforts are needed to accelerate the uncovering of criminal acts through unconventional methods like wiretapping. However, there is a need for strict limitations to protect human rights, especially the right to privacy,” Bayu stated.
“Its use needs to be regulated to prevent abuse of authority,” he added.
Bayu said that such regulation is important to protect the public’s privacy rights, especially for parties not proven to be involved in criminal acts.
“Strict regulation is needed regarding the obligation to destroy wiretapping results that are proven unrelated to the investigated criminal act,” Bayu said during the meeting.
The bill will be discussed as an initiative proposal from the DPR Legislation Body.
The DPR RI Legislation Body stated that the discussion of the Wiretapping Bill must be one of the legislative priorities in 2026.
The reason is that the bill is needed to strengthen the law enforcement process while protecting citizens’ privacy rights from potential abuse of authority.
“So later, the Legislation Body, we will discuss wiretapping here. The addition of this bill is considered important to comprehensively, firmly, and accountably regulate wiretapping practices for law enforcement and the protection of citizens’ privacy rights,” said the Chairman of the DPR RI Legislation Body, Bob Hasan, during a Prolegnas evaluation meeting with the government and the DPD RI on 27 November 2025.
Therefore, Bob assessed the urgency of drafting this policy as directly related to public interests and the consistency of law enforcement in Indonesia.
In addition, Bob reminded that wiretapping is part of criminal law, so it requires more directed regulation without overlapping with other regulations.
