Two Defendants in the Murder of Brigadier Nurhadi Face Eight and 14-Year Sentences
Prosecutors in the trial of the murder case of Brigadier Muhammad Nurhadi requested that the panel of judges impose an eight-year prison sentence on I Gde Aris Chandra Widianto and a 14-year prison sentence on I Made Yogi Purusa Utama.
The prosecutor’s demand was delivered by the representative of the public prosecutor, Budi Mukhlis, in the agenda for each defendant before the panel of judges at the Mataram District Court, Thursday afternoon.
“Requesting that the panel of judges impose a prison sentence of eight years on the defendant I Gde Aris Chandra Widianto,” said Budi in the indictment hearing for defendant Aris Chandra.
In the indictment, the prosecutor assessed that based on the facts of the trial, the defendant Aris Chandra had fulfilled the elements of the crime of aggravated assault and/or obstruction by concealing evidence.
The prosecutor determined this by referring to Article 468 Paragraph (1) of Law Number 1 of 2023 concerning the Criminal Code and Article 221 Paragraph (1) of the Criminal Code Jo. Article 20 letters a or c of Law Number 1 of 2023 concerning the Criminal Code.
The prosecutor in the indictment also burdened the defendant with paying restitution or compensation for the death of Brigadier Nurhadi to the heirs in the amount of IDR 385 million, based on the calculations of the Witness and Victim Protection Agency (LPSK).
“If the defendant does not pay within 30 days, then the defendant’s assets and income will be seized by the prosecutor. If the assets and income still do not cover it, then the defendant is obliged to replace it with a prison sentence of two years,” he said.
After reading the indictment for defendant Aris Chandra, the trial continued for defendant I Made Yogi Purusa Utama.
In the second indictment hearing, the prosecutor requested that the panel of judges impose a prison sentence of 14 years and burden the defendant with paying restitution of IDR 385 million or a subsidiary of two years in prison.
For the defendant Yogi, the prosecutor assessed that his actions had fulfilled the elements of the crime of murder as referred to in Article 458 paragraph (1) of Law Number 1 of 2023 concerning the Criminal Code and Article 221 Paragraph (1) of the Criminal Code Jo. Article 20 letters a or c of Law Number 1 of 2023 concerning the Criminal Code.
