“Yes, today’s court session agenda is the examination of three defendants in the case (alleged kidnapping and murder) of the bank branch head in Jakarta,” said the Spokesperson for the Military Court II-08 Jakarta, Lieutenant Commander (Legal) Arin Fauzam, when contacted by ANTARA in Jakarta on Tuesday.
The defendants, namely Serka MN (defendant 1), Kopda FH (defendant 2), and Serka FY (defendant 3), are accused of being involved in a series of kidnappings accompanied by the murder of MIP.
The hearing is scheduled to take place in the morning, around 10:00, in the Garuda Courtroom or the main courtroom, with the agenda of examining witnesses and defendants.
Based on the Case Search Information System (SIPP) page of the Military Court II-08 Jakarta, the hearing falls under the type of murder case with case number 52-K/PM.II-08/AD/III/2026.
Previously, the Presiding Judge, Colonel Chk Fredy Ferdian Isnartanto, stated that the Tuesday (5/5) hearing would focus on examining the defendants to delve into the chronology of events.
The judge also gave the defendants the opportunity to provide open statements regarding what they experienced in the case.
“Tomorrow, remember the sequence again, tell it here tomorrow as freely and as broadly as possible,” he said.
In the previous hearing, the military prosecutor presented 12 witnesses, including 11 other defendants from a related case in the district court and one witness from the police.
The military prosecutor used a combined indictment construction that includes primary, subsidiary, more subsidiary, alternative, and cumulative charges against the defendants.
The main charge submitted is Article 340 of the Criminal Code on premeditated murder. In this construction, the defendants are alleged to have planned the action in advance that resulted in the loss of the victim’s life.
The prosecutor also prepared other layers of charges as a precaution if the elements of premeditated murder cannot be perfectly proven in the trial, namely the subsidiary Article 338 of the Criminal Code on murder, subsidiary to Article 351 paragraph 3 regarding assault that causes death.
In addition, the prosecutor also submitted an alternative charge in the form of Article 333 paragraph 3 of the Criminal Code regarding deprivation of liberty that causes death.
This charge relates to allegations of kidnapping or unlawful detention of the victim before death.
The defendants are also subject to a cumulative charge under Article 181 of the Criminal Code, which regulates the act of concealing a body. This article indicates allegations of efforts to eliminate traces or obscure facts after the victim’s death.
