Three TNI Soldiers Charged with Premeditated Murder of Bank Branch Head: Details of Prosecutor's Indictment
REPUBLIKA.CO.ID, JAKARTA – Three Indonesian Army (TNI AD) soldiers have been charged with premeditated murder in the case of the alleged kidnapping and killing of a bank branch head (kacab) in Jakarta, initials MIP (37). The kidnapping and murder occurred in August 2025.
“We have charged the three defendants in the case of the alleged kidnapping and murder of the bank branch head, initials MIP. We are using a combined indictment to ensure they cannot escape our charges,” said Military Auditor Colonel Chk Andri Wijaya during the first hearing of the case of the alleged kidnapping and murder of the bank branch head at the Military Court II-08 in Cakung, East Jakarta, on Monday (6/4/2026).
In the trial, the military prosecutor emphasised that they were using a combined indictment structure that includes primary, subsidiary, more subsidiary, alternative, and cumulative charges. This strategy is intended to ensure that all the defendants’ actions can be legally prosecuted without any loopholes for them to evade the demands.
Andri explained that the main charge submitted is Article 340 of the Criminal Code on premeditated murder. In this construction, the defendants are alleged to have planned the action in advance, which resulted in the loss of the victim’s life.
However, the prosecutor also prepared other layers of charges as a precaution in case the elements of premeditated murder cannot be perfectly proven in the trial.
“If the premeditated murder does not meet the elements, we will prove it with the subsidiary article, namely Article 338 of the Criminal Code on murder. Even more subsidiary, Article 351 paragraph 3 regarding assault that results in death,” Andri explained.
In addition, the prosecutor also submitted an alternative charge under Article 333 paragraph 3 of the Criminal Code concerning deprivation of liberty that causes death. This charge relates to the alleged act of kidnapping or unlawful detention of the victim before death.
The defendants were also subjected to a cumulative charge under Article 181 of the Criminal Code, which regulates the act of concealing a body. This article indicates an alleged attempt to eliminate traces or obscure facts after the victim’s death.
“We are accumulating with Article 181 on concealing a body. This is part of the series of actions that we consider interconnected,” Andri stated.
Andri emphasised that this complex indictment formulation is a form of seriousness and caution by the team in uncovering the case. He assured that the trial process will proceed transparently and openly to the public, without any fabrication or attempts to cover up facts.
“We are striving as much as possible to prove the defendants’ actions. We will not fabricate, we will not cover up. Please, the public, especially the victim’s family, witness the course of this trial,” Andri stressed firmly.
