The Directorate General of Taxation (DJP) of the Ministry of Finance has announced that PT Gala Bumiperkasa (GBP) has been imposed with a criminal fine of Rp 214.68 billion for being proven to have deliberately submitted a Notification Letter (SPT) with untrue or incomplete contents. The decision was read out by the Surabaya District Court. In this case, PT GBP was found to have violated Article 39 paragraph (1) of the General Provisions and Tax Procedures Law (KUP). Director of Law Enforcement at DJP, Samingun, stated that the fine amount is twice the amount of tax that was not or underpaid, namely Rp 107.34 billion. In addition to the fine, the court also ordered the confiscation of evidence in the form of the company’s land and building assets. These assets will be auctioned, and the proceeds will be calculated as payment of the fine. Samingun explained that this decision is the culmination of handling the case that faced several obstacles. During the investigation stage, investigators faced four pre-trial attempts as well as the suspect’s absence during the handover of responsibility for the suspect and evidence. He added that the handling of this case is the result of synergy between DJP, the Indonesian National Police (Polri), and the Republic of Indonesia Prosecutor’s Office. According to Samingun, collaboration among law enforcement apparatus is an important factor in facing various challenges until the case can be tried and decided. “Through consistent and fair tax law enforcement, DJP hopes to continue encouraging increased taxpayer compliance and securing state revenues to support healthy and sustainable state finances,” he said.
