South Jakarta Apartment Buyers File Complaint With Komnas HAM Over Difficulties in Securing the AJB
Several buyers of the 45 Antasari Apartment in South Jakarta visited Komnas HAM to lodge allegations of human rights violations on Tuesday afternoon (3 March).
The buyers’ legal representative, Anis Fauzan, said the developer was suspected of human rights violations by obstructing ownership of the apartment units through the Sale and Purchase Deed (AJB).
“There is an effort to obstruct these consumers’ ownership by unilaterally deducting 20 percent from payments already made by customers,” he told reporters.
One buyer, Erik Herlambang, explained that the issue began when he and other buyers purchased the apartments from the developer in 2014. He said the construction process was undertaken by PT Prospek Duta Sukses (PDS). However, the project’s fate became unclear when the developer was declared bankrupt.
“In 2020, in June, there was suddenly a notice of Debt Payment Suspension (PKPU). PKPU leads towards bankruptcy, meaning they no longer have the ability to build,” he said.
Erik said the project was later resumed by another developer. However, he noted that buyers were still asked to pay a further 20 percent of the apartment price.
As a result, Erik said they requested a refund from the developer. The request was refused and the developer offered an AJB consolidation.
“One letter stated that if a consolidation was pursued, a 20 percent penalty would apply. As a result, colleagues who had planned to join withdrew, because it did not align with the talks,” he explained.
The complaint to Komnas HAM is recorded under number 234/ILF/.PENGADUAN/III/2026.
The case resurfaced in 2022 when buyers associated with the Paguyuban Korban Antasari 45 reported losses of up to Rp591.9 billion because the project stalled. The losses stemmed from payments already deposited by prospective residents to Prospek Duta Sukses.
The losses arise from payments already made by 775 buyers for 923 units to PT PDS, the developer of the 45 Antasari Apartment project.
In 2014, the company was deemed not to have an Building Construction Permit (IMB) amid aggressive marketing of housing units. The developer could not demonstrate physical or financial progress to date.
The developer had collected Rp591.5 billion from apartment sales, plus a US$25 million loan from foreign creditor Ultimate Idea Limited (UIL). Yet the developer could not continue with construction.
Ultimately, Prospek Duta Sukses was declared bankrupt in the PKPU process. While in bankruptcy, the two sides reached a settlement agreement, but the agreement was deemed to violate the regulations.
Meanwhile, PT Prospek Duta Sukses (PDS) management had previously asserted that construction on the 45 Antasari Apartment project would continue. The President Director, AH Bimo Suryono, was optimistic that the project could proceed as PT Indonesian Paradise Property Tbk (INPP) had become a controlling shareholder, directly or indirectly, by September 2021.
“Development of 45 Antasari continues with Indonesian Paradise Property as the controlling shareholder,” Bimo said in an official statement at the time.
