JAKARTA, KOMPAS.com - Constitutional Court Justice Saldi Isra has once again questioned the issue of expired quotas in the hearing on the judicial review petition for Law No. 6 of 2023 on Telecommunications.

He stated that what the operator side conveyed—that they do not profit from the expired quota policy—is indeed true.

However, this cannot negate the fact that expired quotas cause losses to others, particularly the petitioners.

“It is said that if it is not used, it does not benefit the operator. Well, I say that is true,” Saldi said during the hearing for case numbers 273/PUU-XXIII/2025 and 33/PUU-XXIV/2026, held on Monday (4/5/2026).

He hopes that the relevant parties and respondents can provide explanations by bringing in experts to counterbalance the current explanations from the operators.

“But there must also be an explanation: here it is indeed not profitable, but here (someone) is harmed. Later, when seeking experts, they can balance those explanations,” Saldi said.

The explanation regarding no profit from expired quotas was provided by telecommunications operators in the previous hearing.

This was conveyed in the hearing at the Constitutional Court (MK) for petitions Numbers 33/PUU-XXIV/2026 and 273/PUU-XXIII/2025, which challenge the scheme of remaining internet quotas, on Thursday (16/4/2026).

“Mobile operators do not obtain additional benefits from the remaining volume or data not used by customers within a certain period chosen by the customer,” said Vice President of Simpati Product Marketing, Adhi Putranto, representing Telkomsel in the hearing, quoted from the MKRI YouTube broadcast, Friday (17/4/2026).

In that hearing, Adhi also emphasised that the term “internet quota expires” is not appropriate.

Meanwhile, Sukaca Purwokardjono, Chief Customer Experience representing XL, stated that the internet services provided follow government regulations and are strictly supervised.

He also mentioned that internet quotas are not goods that can be owned by customers.
