Restorative Justice Applied to Resolve Case of Motorcycle Taxi Driver Who Fatally Injured Passenger in Pandeglang
Serang, VIVA – The Banten Regional Police are processing a restorative justice mechanism in handling a traffic accident case in Pandeglang involving motorcycle taxi driver Al Amin Maksum, which resulted in the death of his passenger, Khairi Rafi.
Head of Public Relations of the Banten Regional Police, Commissioner Maruli Hutapea, said that this step was taken after both parties agreed to reconcile and submit a request for restorative justice.
“The parties have agreed to hold a deliberation and pursue a restorative justice mechanism. Investigators from the Pandeglang Police have facilitated this process,” Maruli told the media in Serang City on Wednesday.
He explained that with the letter of request from both parties, investigators will immediately process the request in accordance with the provisions.
“With the letter of request for restorative justice from both parties, the investigators will immediately process the request and issue a Letter of Termination of Investigation (SPPD) in accordance with the applicable mechanism,” he said.
Maruli emphasised that the case is still in the investigation stage and no suspects have been named.
“Regarding the issue circulating on social media that a suspect has been named, we would like to emphasise that, to date, no suspect has been named and the process is still in the investigation stage,” he said.
He added that the termination of the investigation will be carried out after all the requirements for restorative justice have been met and both parties have signed a deliberation agreement.
“Both parties have realised that the incident was a disaster from God Almighty and have forgiven each other as stated in the statement of deliberation,” he said.
The case began with a report from the victim’s family to the Pandeglang Police regarding an accident that occurred on Tuesday, January 27, 2026, at around 12.30 pm on Jalan Raya Pandeglang-Labuan.
The incident involved a village ambulance and a black Revo motorcycle driven by Al Amin. The motorcycle passenger died in the incident.
Based on the report, the police issued a letter of investigation and examined witnesses who knew about the incident at the scene.
Maruli emphasised that this step was not to suppress the reporting.
“It should be emphasised that this step is not to suppress the media. We are not suppressing the reporting. Let the public judge objectively,” he said.
