Rental Car Seized by Debt Collectors on the Road, Owner Reports to Bali Police
A rental car in Badung, Bali, was allegedly seized by debt collectors in the middle of the road. The unilateral repossession was immediately reported to Polda Bali.
The incident occurred on Wednesday (1/4/2026) at Jalan Kebon Nomor 23, Buduk, Mengwi, Badung. The Wuling Binguo vehicle with registration DK 1138 ADP was forcibly taken by an individual with initials L along with several accomplices while it was being used by the rental customer, Safira Yusuf.
The legal representative of the complainant, Sabam Antonius Nainggolan, stated that the vehicle was one of two units purchased by his client through financing.
“Our client bought two units at once of the same type. However, during the incident, only one unit was taken. Why not both, we don’t know yet. Perhaps at that time, the debt collectors only spotted that unit,” said Sabam Antonius Nainggolan in Denpasar on Friday (10/4/2026).
According to Sabam, both units were indeed delayed in payments for three months. However, payments were still being made, and his client still had good intentions to continue fulfilling the obligations.
“These two units were a bit late in payments due to the circumstances. But they are still being paid, and our client still intends to continue the payments,” he said.
He mentioned that his client had also attempted to communicate with the financing party to request leniency.
“That’s why there had been discussions beforehand to request leniency given the situation faced by our client,” he added.
However, Sabam said, the financing party instead appointed a third party to repossess the vehicle. He deemed this action unjustifiable under the law without a court decision as basis.
“If they really want to execute, attach a court decision stating that this vehicle must be executed immediately. It cannot be done forcibly in the field,” he said.
He emphasised that the dispute over delayed payments is a civil matter, so it cannot be used as a basis for unilateral repossession. Moreover, he said, Constitutional Court Decision Number 18/PUU-XVII/2019 requires the surrender of fiduciary objects to be voluntary or through legal mechanisms.
“The Constitutional Court decision is very clear: the surrender of fiduciary objects must be done voluntarily. In fact, neither our client nor her husband ever gave permission to take that unit,” he said.
In response to the incident, the vehicle owner reported L and his accomplices to Polda Bali with report number LP/B/289/IV/2026/SPKT/POLDA BALI on the same day.
Sabam stated that the vehicle is now suspected to be in an auction warehouse in Denpasar.
“We remind that the vehicle object, which is currently under criminal legal proceedings, should not be sold or auctioned until there is legal certainty,” he said.
The legal representatives hope that the report will be promptly followed up by the authorities regarding the alleged forcible repossession that is deemed to violate procedures.
