Reasons Why the Judge Did Not Order Riva Siahaan to Pay Restitution in the Crude Oil Case
Former Director of PT Pertamina Patra Niaga (PT PPN), Riva Siahaan, was sentenced to 9 years in prison in a corruption case involving the management of crude oil, but was not ordered to pay restitution. The judge stated that Riva did not benefit from the proceeds of corruption in the case.
“Considering that in the trial, it was not proven that the defendant, Riva Siahaan, received money from the corruption that harmed state finances, therefore the defendant is not required to pay restitution as referred to in Article 18 of the Law on Criminal Acts of Corruption,” said Judge Sigit Herman Binaji while reading the verdict at the Jakarta Central Corruption Court, Thursday (26/2/2026).
The judge stated that because Riva did not receive money from the corruption, he was not required to pay restitution. The judge also ordered the unfreezing of Riva’s accounts that were not related to this case.
“Considering that regarding the evidence in the form of money and bank savings books that were blocked, because they are not related to the criminal act, therefore the block on the bank savings books must be lifted,” said the judge.
Previously, the panel of judges stated that the element of harming state finances in the corruption case involving the management of crude oil had been fulfilled. The judge argued that there was a loss of state finances amounting to Rp 9.4 trillion in the case, according to calculations by the Supreme Audit Agency (BPK).
“That based on the results of the investigative report by the BPK RI No. 26 and so on, which was carried out in order to calculate the loss of state finances in the management of oil by the Ministry of ESDM, there was a loss of state finances for PT Pertamina amounting to Rp 2,545,277,386,935 (2.5 trillion), which is part of the total loss of state finances in the sale of non-subsidized diesel fuel by PT Pertamina and PT PPN in 2018-2023, totaling Rp 9,415,196,905,676.86 (9.4 trillion),” said Judge Sigit Herman Binaji while reading the verdict at the Jakarta Central Corruption Court.
The judge stated that the calculation of economic losses to the state of Rp 171,997,835,294,293 (Rp 171 trillion) was still based on assumptions. The judge stated that the calculation was not real and not certain.
“The panel of judges considered that because the loss of state finances was strengthened by the testimony of experts Nailul Huda and Wiko Saputra, it was based on assumptions, so the panel of judges considered that the calculation was based on assumptions and there were many factors that influenced it, so it was not certain and not real, so it could not be proven that there was a loss to the state economy,” said the judge.
The judge stated that he agreed with the BPK’s calculations. However, the judge stated that he did not agree with the calculation of economic losses from experts Nailul Huda and Wiko Saputra.
“The panel agrees with the BPK’s calculations, except for the calculation of economic losses calculated by economic experts Nailul Huda and Wiko Saputra, which are still based on assumptions, uncertain, because there are many factors that influence the formulation of calculating state financial losses, so there is not enough evidence regarding losses to the state economy,” said the judge.
“Considering that based on the series of considerations above, the element of being able to harm state finances can be fulfilled,” continued the judge.
In this case, the judge has handed down sentences for Riva Siahaan (RS) as the former Director of PT Pertamina Patra Niaga, Maya Kusmaya (MK) as the former Director of Marketing Center and Trading at PT Pertamina Patra Niaga, and Edward Corne (EC) as the former VP of Trading Operations at PT Pertamina Patra Niaga. The judge stated that Riva, Maya, and Edward had been proven guilty of corruption in this case.

Maya Kusmaya was sentenced to 9 years in prison and a fine of Rp 1 billion or 190 days of imprisonment.
Edward Corne was sentenced to 10 years in prison and a fine of Rp 1 billion or 190 days of imprisonment.
