The Badung District Prosecutor’s Office (Kejari) has filed an appeal against the sentences handed down to three defendants in a shooting case that resulted in the death of Australian national Zivan Radmanovic and injuries to Sanar Ghanim at a villa in Munggu Village, Mengwi District. The prosecutors argue that the judges’ verdict does not adequately reflect justice given the fatal consequences of the incident.

“The Public Prosecutors have registered an appeal last Friday for the cases of defendants Darcy Francesco Jenson, Mevlut Coskun, and Paea-I-Meddlemore Tupou. This submission was made officially through the electronic system and its status has been verified by the court,” stated Gde Ancana, Chief of Intelligence at Badung District Prosecutor’s Office, on Saturday (14 March 2026).

Ancana stated that the appeal has been verified by Denpasar District Court before being forwarded to Denpasar High Court.

According to Ancana, the decision to appeal was made after prosecutors determined that the sentences imposed by the judges were not proportionate to the impact of the defendants’ actions. The shooting at the villa resulted in the death of Zivan Radmanovic, whilst Sanar Ghanim sustained serious injuries.

“Our consideration is that the impact of these defendants’ actions is extremely serious, with one victim deceased and another critically wounded. The Public Prosecutors believe that the sentence imposed by the judges does not adequately reflect the justice that the community should receive,” said Gde Ancana.

Criticism of Emergency Law Charges

Prosecutors also scrutinised the verdict against defendant Darcy Francesco Jenson. In the prosecutors’ view, the judges failed to consider the third charge related to Emergency Law No. 12 of 1951.

Prosecutors contend that Darcy facilitated Mevlut and Paea’s ability to obtain and use firearms when carrying out the shooting.

“In our points of objection, we observe that the judges completely disregarded the Emergency Law provision concerning assistance in the use of firearms in the verdict against Darcy. Yet his role was clearly demonstrated in helping his two colleagues to obtain the weapon that caused the deaths,” Ancana stated firmly.

The judges at Denpasar District Court had previously sentenced defendant Darcy Francesco Jenson (37) to 12 years’ imprisonment. In the same case, the other two defendants—Tupou Pasa Midolmore and Coskunmevlut—were each sentenced to 16 years’ imprisonment, having been found guilty of murder.

“We now await the completion of the administrative process to monitor the outcome of the Denpasar High Court’s ruling. All points of objection have been compiled in our appeal memorandum as material for the judges’ consideration at the appellate level,” he concluded.
