“We also reported that there is a difference of opinion regarding the method of appointing the Kapolri. Some of us believe that the appointment of the Kapolri does not need to be confirmed or receive approval from the DPR, while others believe it should remain as it is now. After discussing the pros and cons, the President directed that it should stay as it is now,” said Jimly at the Presidential Palace in Central Jakarta on Tuesday (5/5/2026). He stated that the Kapolri is still appointed by the President. He mentioned that the name of the prospective Kapolri will be submitted by the President to the DPR for approval or rejection. “So the Kapolri is still appointed by the President with the approval of the DPR, as per the current practice. This applies to both the Polri and the TNI Commander in accordance with the law; it is not a fit and proper test in the DPR. But whether it is approved or not, that is called the DPR’s right to concern,” he said. He noted that this practice has been in place for a long time. He added that the DPR has always approved the President’s candidates for Kapolri so far. “The President only proposes the name. The DPR may agree or disagree, although in practice so far it has always been approved. So after a long discussion, the President decided to keep it as it is now,” he said.
