Police to Terminate Motorcycle Taxi Driver Investigation Following Restorative Justice Agreement in Pandeglang
The Banten Regional Police stated that restorative justice (RJ) has been implemented in the case of a motorcycle taxi driver who was reported after his passenger died in an accident caused by a pothole on a road in Pandeglang. The police will halt the investigation into the case after the RJ process is completed.
The Head of Public Relations of the Banten Regional Police, Commissioner Maruli Hutapea, said that the RJ, or mediation process, was carried out on Tuesday (24 February 2026). The mediation was attended by the victim’s family and the motorcycle taxi driver, Al Amin Maksum.
“With the restorative justice agreed upon by all parties, the investigators from the Traffic Unit will take further action,” said Maruli on Wednesday (25 February 2026).
The police will soon issue a letter terminating the investigation because an agreement has been reached between the victim’s family and the reported party.
“A letter terminating the investigation will be issued. Previously, a report was filed by the victim’s family to the Pandeglang Police,” he said.
Meanwhile, Amin’s lawyer, Airlangga, said that the victim’s family and the reported party had reached an agreement and were reconciled.
“They have realised that the accident was a tragedy and have accepted it. They have forgiven each other. Therefore, the requirements and conditions have been met, so the police will soon issue a letter terminating the investigation,” said Airlangga.
Previously, it was reported that a motorcycle taxi driver in Pandeglang, named Al Amin Maksum, was reported to the police by the parents of Khairi Rafi, a fifth-grade elementary school student. The parents of Khairi Rafi were upset that their child died while riding on Amin’s motorcycle.
Elang Mulyana stated that the incident occurred on Tuesday (27 January) on the Labuan-Pandeglang highway, specifically in Kampung Gardutanjak, Pandeglang Regency. At that time, the victim, Khairi Rafi, died after the motorcycle driven by Al Amin hit a pothole in the road.
“After they fell, they were hit by an ambulance that was behind them. Both suffered severe injuries, but the victim died,” he said.
Due to this incident, the victim’s parents reported the incident to the Pandeglang Police. Elang said that mediation had been attempted several times, but it had not yielded any results.
Elang said that Amin was initially named as a suspect. He also questioned this information.
“Legal responsibility should be directed towards the road operator, namely the local government. The damaged road is considered to be the main factor causing the accident that claimed the victim’s life,” he said.
Meanwhile, the Head of Public Relations of the Banten Regional Police, Commissioner Maruli Hutapea, said that the perpetrator has not yet been named as a suspect. He stated that the case is still in the investigation stage.
“It should be noted that, as of today, the investigators from the Pandeglang Traffic Unit are still investigating. The status is still under investigation. It is confirmed that there has been no designation of a suspect, as reported in the viral news. So, there is no designation of a suspect yet,” said Maruli.
However, Maruli said that the victim’s parents reported the incident to the Pandeglang Police. “The status (of Amin) is as the reported party,” he said.
