The government is currently drafting new non-tax state revenue (PNBP) fees for intellectual property (IP) services through amendments to Government Regulation No. 45 of 2024. These new fees are targeted to take effect this year once established by President Prabowo Subianto. “We are endeavouring for them to apply starting this year. However, implementation will follow the establishment of the government regulation by the President,” said Ririn Kadariyah, Director of PNBP for Ministries/Agencies at the Ministry of Finance, to CNBC Indonesia on Friday (10/4/2026). These IP PNBP fee changes will encompass registrations to extensions for various IP services, including Copyright and Industrial Design; Patents, Layout Designs of Integrated Circuits, Trade Secrets; and Trademarks and Geographical Indications. Not all will see fee increases. Ririn emphasised that decisions on the fee changes have not yet reached the final stage, as following the public consultation held yesterday by the Directorate General of Intellectual Property (DJKI) on (9/4/2026), there were many inputs from stakeholders. Stakeholders present at the public consultation included creative industry players, micro, small, and medium enterprises, legal entities, IP consultants, the All-Indonesian Composers’ Association (AKSI), and Intellectual Property Centres. “There were various inputs yesterday that we are currently following up with discussions involving related agencies. We will inform you once it is clear,” Ririn stated firmly. Prior to the public consultation, DJKI had conducted a series of analysis stages, including impact analysis, performance and effectiveness analysis, evaluation of business process simplification, service burden calculations, preparation and refinement of the Cost Budget Plan (RAB), and benchmarking with equivalent intellectual property service practices in other countries. These steps were taken to ensure the policies are data-based and accountable. The adjustment of IP service PNBP fees is driven by evolving service needs, increasing business process complexity, and the utilisation of digital technology in services. The policy is also aimed at supporting the development of more detailed Standard Operating Procedures (SOPs) and the implementation of tiered fee mechanisms for micro and small enterprises (UMK) as a form of government support. From the public consultation presentation obtained by CNBC Indonesia, for example, the fee for trademark registration applications by SMEs will remain at Rp 500,000 per class, although there will be nomenclature adjustments. However, for general trademark registration applications, there will be an increase of around 94.4% from the previous Rp 1.8 million per class set in PP 45/2024, with the new proposal in the public consultation being Rp 3.5 million per class. Nevertheless, DJKI emphasised that complete information on the types of services and changed fees cannot yet be disclosed, as after yesterday’s Public Consultation, many inputs from stakeholders will be discussed again by the Inter-Ministerial Committee. “It will still be discussed first in response to the inputs gathered during the public consultation,” said DJKI representatives. Therefore, DJKI stressed that all fee proposals presented in the public consultation are still tentative and not yet the government’s sole decision. The public consultation was attended by IP consultants, academics, business actors, and creative industry players. It is important to note that trademark registration fees have not increased in the last decade, with the last change in 2016 through the issuance of PP 45/2016. Meanwhile, the target for completing the amendment to PP 45/2024 cannot yet be informed by DJKI, including whether it will be implemented this year or not.
