NasDem Wants New Labour Law Discussed by DPR Commission IX After Constitutional Court Ruling

The Constitutional Court (MK) has requested that the DPR create a new Labour Law separate from the Job Creation Law. Member of Commission IX of the DPR and Deputy Chair of the NasDem Central Executive Board, Irma Suryani Chaniago, explained the progress in forming the said law.

“When will Commission IX start working on the Labour Law mandated by the MK? We in Commission IX have actually already formed a working group and completed it. The plan is for the leadership of Commission IX to write to the DPR leadership at the deliberation body meeting in the next session,” said Irma to reporters on Wednesday (22/4/2026).

She stated that Commission IX of the DPR is the working partner of the Ministry of Manpower. According to her, Commission IX of the DPR is responsible for discussing the new Labour Bill.

“As the working partner commission for the Minister of Manpower, we are certainly responsible for working on this law, especially since we have invited representatives from labour unions and employers several times to obtain comprehensive input,” she said.

This NasDem Deputy Chair stated that her side wants the Labour Law to be handled by Commission IX of the DPR. She admitted she does not want the new Labour Law to be immediately challenged after being promulgated, like the Job Creation Law.

“As a note, the Job Creation Law was made by the Legislation Body and then issued by the MK in judicial review. Therefore, learning from that situation, we as the commission that is the leading sector and working partner of the Ministry of Manpower certainly do not want this law to enter judicial review again once promulgated,” she said.

She hopes the new Labour Law will be fully handled by Commission IX of the DPR. She targets the law to benefit workers and employers.

“For that, insyaallah we will maintain that this law is handled in Commission IX, not in the Legislation Body. Insyaallah, this law will truly benefit both parties, because without employers, jobs are not created, and likewise without workers, companies cannot operate,” she said.

For information, the MK views that the government and DPR need to create a new Labour Law. The new law is requested to be separate from the Job Creation Law that was formed in 2023.

This was conveyed by the MK in the reading of the decision in case number 168/PUU-XXI/2023 regarding the material examination of the Job Creation Law on Thursday (31/10/2024). One of the petitioners in this case is the Labour Party.

“According to the Court, the lawmakers shall immediately form a new labour law and separate or remove it from what is regulated in Law 6/2023,” reads the MK’s decision.
