Jakarta — Commission III Chair of the House of Representatives Habiburokhman has disclosed a message from President Prabowo Subianto regarding fair legal proceedings, drawing lessons from the defamation case involving celebrity and Bibi Kelinci restaurant owner Nabilah O’Brien and her customer Zendhy Kusuma.

“President Prabowo Subianto has entrusted us with a message to avoid miscarriage of justice in legal proceedings, to ensure that ordinary citizens who are party to cases can smile because they have received justice,” Habiburokhman said at Parliament Complex in Jakarta on Monday (9 March 2026).

He stressed that Commission III of the House of Representatives, which discusses and ratifies the new Criminal Code and Criminal Procedure Code, is committed to ensuring that the implementation of these policies must be properly applied in accordance with the spirit of legal norms.

According to him, the legal paradigm that previously pursued retributive and formalistic justice must shift towards restorative, rehabilitative, and substantive justice.

“Not all legal disputes in society need to be resolved in court. Minor legal disputes in the community should, as much as possible, be resolved amicably outside of court,” he said.

Specifically regarding the Nabilah case, he stated that Commission III of the House of Representatives deemed it necessary to respond as an implementation of the House’s constitutional obligation to conduct oversight.

Nabilah, who was a victim of theft, was previously designated as a suspect by the National Police (Bareskrim) for alleged violations of the Information and Electronic Transactions Law (UU ITE) related to defamation and slander.

Habiburokhman explained that for the past week, Commission III of the House has been in intensive communication with the National Police to facilitate a legally appropriate solution.

“Alhamdulillah, on Sunday night last week, the report against Nabilah O’Brien was withdrawn and consequently she no longer has the status of suspect and this matter has been terminated,” Habiburokhman said.

“On the other hand, Nabilah O’Brien has also forgiven the suspect in the theft case and withdrawn her report,” he added.

“Commission III of the House of Representatives considers that Nabilah O’Brien demonstrably does not meet the elements of unlawfulness and intent to slander or defame another person,” he continued.
