Nabilah O'Brien Applies for a Special Case Review, Seeks Case Dismissal
Nabilah O’Brien has filed for a special case review with the Wassidik Bureau of Investigation at the Indonesian Police’s Criminal Investigation Directorate (Bareskrim Polri), following her designation as a suspect after posting CCTV footage related to a theft at her restaurant. Her lawyer, Goldie Natasya Swarovski, told a press conference in South Jakarta on Friday that they had submitted a public complaint and a request for a special case review to ensure the client receives justice, and that there is indeed a basis for stopping the investigation if the criminal elements are not fulfilled. She said that late last night Nabilah was also questioned by Paminal, Polri’s Internal Security unit, relating to the case. “Last night, we spent until midnight at Paminal to respond,” she added. “They (Paminal) responded quickly and actively, inviting us to stay until midnight to listen to my testimony as the lawyer about the process of the investigation.” Earlier, Nabilah O’Brien admitted to being named a suspect after discussing the case of the theft she experienced on social media. She shared the remarks via her Instagram account @nabobrien. “I am a victim of theft who has been made a suspect in the Polri’s Bareskrim,” she wrote in a post quoted on Friday. As background, the case began when a husband-and-wife pair identified by initials ZK and ER vented their anger after their meal at Nabilah’s restaurant did not arrive. Not only did they curse the kitchen staff, they also took food away without paying. Nabilah subsequently reported ZK and ER to the police. After investigation, ZK and ER were named suspects. Regarding this, Public Relations Head of Polda Metro Jaya, Kombes Budi Hermanto, said there were two separate matters at Nabilah’s restaurant. The first is a suspected crime of theft under Article 363 of the Indonesian Penal Code being handled by Mampang Prapatan Police. “Where NAA (Nabilah) as the victim reported ZK and ESR; the two suspects have been named and are scheduled for questioning on Monday, 9 March 2026, but her counsel has sent a letter requesting a postponement of the examination,” Budi explained. The second matter concerns a CCTV recording posted on social media, handled by the Dittipidsiber of Bareskrim Polri, in which Nabilah is in the position of a suspect. “So it should be understood that these are two different cases with different objects. In other words, whatever is done by both parties has legal consequences,” he added. “Polri remains professional, proportionate and transparent in handling the cases,” he concluded.
