Motorcycle Taxi Driver Sues Pandeglang Regency and Banten Provincial Government, Demands Rp 100 Billion Compensation

A resident of Pandeglang named Al Amin, a motorcycle taxi driver, became a victim of a traffic accident due to damaged road infrastructure in Pandeglang Regency, Banten. Amin has sued the Pandeglang Regency Government and the Banten Provincial Government.

“Mr Amin has registered his lawsuit with Pandeglang District Court, demanding compensation as he became a victim of a traffic accident,” said Al Amin’s legal representative, Raden Elang Mulyana, at Pandeglang District Court on Wednesday (25 February 2026).

Elang stated that the lawsuit filed seeks compensation from the government totalling Rp 100 billion. He said the funds would subsequently be used to repair damaged roads in Banten Province.

“The purpose of our lawsuit is to demand compensation of Rp 100 billion from the government. The intention is that it will later be handed over to victims of accidents that have occurred in Banten, and the money will be used to repair potholes and damaged roads, that is the objective,” he said.

Another legal representative, Ayi Erlangga, added that this civil lawsuit concerns unlawful conduct as it has resulted in loss of life due to government negligence. He stated that four parties have been sued. First is the Governor of Banten, the Regent of Pandeglang, the Banten Provincial Public Works and Public Housing Office (DPUPR), and the Pandeglang Transportation Office (Dishub). Additionally named as a co-defendant is an ambulance driver.

“The subject matter of the lawsuit is centred on unlawful conduct. The parties being sued are first the Governor of Banten Province, the Head of Banten’s DPUPR, the Regent of Pandeglang, and also the head of Pandeglang’s Transportation Office. Together with the co-defendant, who is an ambulance driver,” he said.

“The core issue is road repair that has injured residents, demanding compensation of Rp 100 billion. We will distribute all that money to the people of Banten,” he added.

Response from Banten Provincial Government

The Banten Provincial Government is one of the parties being sued in a civil case due to damaged Labuan Main Road in Pandeglang Regency. The provincial government will face the lawsuit filed by motorcycle taxi driver Al Amin Maksum.

Acting Head of the Legal Bureau of Banten Provincial Government, Hadi Prawoto, expressed the provincial government’s condolences for the death of a primary school child who fell whilst being carried by Amin. The motorcycle driven by Amin fell after hitting a pothole on Labuan-Pandeglang Main Road.

He stated that suing the government is a right of citizens. For him, the government is not above the law and every policy must be open to scrutiny.

“We respect the legal measures taken by the community. That is a constitutional right of citizens,” said Hadi.

“For us, a lawsuit is not merely a matter of winning or losing in court. What is more important is ensuring public safety, accelerating infrastructure repairs, and conducting an evaluation of the existing maintenance system,” he said.

According to Hadi, if a local government policy has shortcomings, it will become a matter for improvement. However, if what the government has done complies with standards, the provincial government will prove it in court.

“If indeed there are shortcomings, of course that will be grounds for improvement. But if the government has worked in accordance with standards and the provisions of laws and regulations, then we will also prove that legally,” he said.

He added that the provincial government applies a responsive, transparent, and accountable approach in providing public services, particularly in the field of infrastructure that affects the welfare of the general public.
