        "content": "<p>A resident of Pandeglang named Al Amin, a motorcycle taxi driver,\nbecame a victim of a traffic accident due to damaged road infrastructure\nin Pandeglang Regency, Banten. Amin has sued the Pandeglang Regency\nGovernment and the Banten Provincial Government.<\/p>\n<p>\u201cMr Amin has registered his lawsuit with Pandeglang District Court,\ndemanding compensation as he became a victim of a traffic accident,\u201d\nsaid Al Amin\u2019s legal representative, Raden Elang Mulyana, at Pandeglang\nDistrict Court on Wednesday (25 February 2026).<\/p>\n<p>Elang stated that the lawsuit filed seeks compensation from the\ngovernment totalling Rp 100 billion. He said the funds would\nsubsequently be used to repair damaged roads in Banten Province.<\/p>\n<p>\u201cThe purpose of our lawsuit is to demand compensation of Rp 100\nbillion from the government. The intention is that it will later be\nhanded over to victims of accidents that have occurred in Banten, and\nthe money will be used to repair potholes and damaged roads, that is the\nobjective,\u201d he said.<\/p>\n<p>Another legal representative, Ayi Erlangga, added that this civil\nlawsuit concerns unlawful conduct as it has resulted in loss of life due\nto government negligence. He stated that four parties have been sued.\nFirst is the Governor of Banten, the Regent of Pandeglang, the Banten\nProvincial Public Works and Public Housing Office (DPUPR), and the\nPandeglang Transportation Office (Dishub). Additionally named as a\nco-defendant is an ambulance driver.<\/p>\n<p>\u201cThe subject matter of the lawsuit is centred on unlawful conduct.\nThe parties being sued are first the Governor of Banten Province, the\nHead of Banten\u2019s DPUPR, the Regent of Pandeglang, and also the head of\nPandeglang\u2019s Transportation Office. Together with the co-defendant, who\nis an ambulance driver,\u201d he said.<\/p>\n<p>\u201cThe core issue is road repair that has injured residents, demanding\ncompensation of Rp 100 billion. We will distribute all that money to the\npeople of Banten,\u201d he added.<\/p>\n<p>Response from Banten Provincial Government<\/p>\n<p>The Banten Provincial Government is one of the parties being sued in\na civil case due to damaged Labuan Main Road in Pandeglang Regency. The\nprovincial government will face the lawsuit filed by motorcycle taxi\ndriver Al Amin Maksum.<\/p>\n<p>Acting Head of the Legal Bureau of Banten Provincial Government, Hadi\nPrawoto, expressed the provincial government\u2019s condolences for the death\nof a primary school child who fell whilst being carried by Amin. The\nmotorcycle driven by Amin fell after hitting a pothole on\nLabuan-Pandeglang Main Road.<\/p>\n<p>He stated that suing the government is a right of citizens. For him,\nthe government is not above the law and every policy must be open to\nscrutiny.<\/p>\n<p>\u201cWe respect the legal measures taken by the community. That is a\nconstitutional right of citizens,\u201d said Hadi.<\/p>\n<p>\u201cFor us, a lawsuit is not merely a matter of winning or losing in\ncourt. What is more important is ensuring public safety, accelerating\ninfrastructure repairs, and conducting an evaluation of the existing\nmaintenance system,\u201d he said.<\/p>\n<p>According to Hadi, if a local government policy has shortcomings, it\nwill become a matter for improvement. However, if what the government\nhas done complies with standards, the provincial government will prove\nit in court.<\/p>\n<p>\u201cIf indeed there are shortcomings, of course that will be grounds for\nimprovement. But if the government has worked in accordance with\nstandards and the provisions of laws and regulations, then we will also\nprove that legally,\u201d he said.<\/p>\n<p>He added that the provincial government applies a responsive,\ntransparent, and accountable approach in providing public services,\nparticularly in the field of infrastructure that affects the welfare of\nthe general public.<\/p>",
