Minister of Law Outlines Key Points of International Civil Law Bill to Parliament
Jakarta – The Minister of Law Supratman Andi Agtas outlined several key points that will be regulated in the proposed bill on International Civil Law (HPI).
The politician from Gerindra party stated that, broadly speaking, the HPI bill will regulate various aspects of civil law involving cross-border elements.
“In broad terms, the HPI bill regulates the principles and main instruments of international civil law, the subjects of civil law and the determination of their legal status, family law involving foreign elements, property and property rights applicable to moveable property, immoveable property, and registered property,” said Supratman during the inaugural meeting of the Special Committee (Pansus) between the government and the Indonesian Parliament at the Parliament Building in Jakarta, Wednesday (11 March 2026).
Additionally, the bill will also regulate inheritance involving foreign elements, cross-border contracts or agreements, and the determination of law applicable to unlawful acts across borders.
“The determination of the jurisdictional authority of Indonesian courts to hear and decide civil disputes containing foreign elements, as well as the determination of conditions and the regulation of mechanisms for the recognition and enforcement of foreign court decisions in civil cases within Indonesian territory,” he said.
Supratman noted that the HPI bill is necessary to provide clear guidance in handling various increasingly complex cross-border civil law issues in the era of globalisation.
The state, he said, needs to be present to provide protection and legal certainty for Indonesian legal subjects dealing with foreign parties.
Supratman stated that the formation of the HPI bill was also driven by the need to update old regulations that still refer to Dutch colonial-era legal products.
Currently, the regulation of international civil law in Indonesia still refers to Articles 16, 17, and 18 of the Algemene Bepalingen van Wetgeving (General Provisions of Legislation) and Article 436 of the Reglement op de Rechtsvordering (Code of Civil Procedure).
“This is increasingly inadequate to address the complexity of transnational legal issues,” said Supratman.
“Therefore, the formation of this HPI bill is a strategic step to provide protection and legal certainty for legal subjects, provide comprehensive guidance for judges, and increase national competitiveness as well as enhance the confidence of foreign parties in Indonesia’s legal system in a systematic and integrated regulation,” he concluded.
The Parliament officially formed the Special Committee for the proposed bill on Industrial Design and the proposed bill on International Civil Law during the 10th plenary session of the second sitting of the 2025–2026 parliamentary term at the Parliament Complex in Senayan, Jakarta, Monday (8 December 2025).
On 12 November 2025, the leadership of Parliament and the faction leaders held a consultation meeting in place of the Steering Committee meeting to decide on the formation of the special committees for the bill on Industrial Design and the bill on International Civil Law.
