Jakarta (ANTARA) - The Military Court II-08 Jakarta has officially received the case file from the Military Prosecutor’s Office II-07 Jakarta regarding the alleged assault on KontraS activist Andrie Yunus from the Commission for the Disappeared and Victims of Violence.

“Indeed, today, the Military Court II-08 Jakarta has received the transfer of the case file from the Military Prosecutor’s Office II-07 Jakarta. The case in question is the alleged acid splashing against the KontraS activist, which will soon be tried,” said the Head of the Military Court II-08 Jakarta, Colonel Chk Fredy Ferdian Isnartanto, at the Military Court II-08 Jakarta on Thursday.

He assured that the court would promptly follow up on the transfer with judicial administrative processes before entering the first trial.

According to Fredy, after receiving the case file, the next stage would be the appointment of the panel of judges to examine and adjudicate the case.

In addition, the clerk would prepare the schedule for the first trial and ensure that the summoning of relevant parties is carried out in accordance with legal provisions.

Fredy stated that the summoning of the defendants and witnesses must be done lawfully and properly, namely at least three days before the trial is held.

This is important to ensure the smooth running of the trial process and the fulfilment of the rights of all related parties in the case.

All four previously held suspect status and now officially become defendants after the case file was transferred to the court.

“The four individuals will undergo the trial process at the Military Court II-08 Jakarta. Their status has changed from suspects to defendants,” Fredy said.

Meanwhile, the Head of the Military Prosecutor’s Office, Colonel Chk Andri Wijaya, explained that the transfer of the case file was carried out after all investigation and case review processes were declared complete.

He said the case file had met both formal and material requirements, as stipulated in military procedural law.

“We have examined this case file and declared it complete, both formally and materially. Therefore, we have transferred it to the Military Court II-08 Jakarta for immediate trial,” Andri stated.

He added that the transfer of the case was also accompanied by the Minutes of the Prosecutor’s Opinion and the Legal Opinion Letter from the Head of the Military Prosecutor’s Office (Kaotmil).

In addition, the decision on the submission of the case from the Case Submission Officer (Papera) had been received, allowing the transfer process to be carried out lawfully.

Of the eight witnesses, five are military members, while the other three are from civilian circles.

In the construction of the indictment, the Military Prosecutor applies a layered or subsidiarity indictment system against the defendants. For the primary indictment, the defendants are charged under Article 469 paragraph (1) of the Criminal Code in conjunction with Article 20 letter C of Law Number 1 of 2023, with a maximum penalty of 12 years imprisonment.

Next, the subsidiarity indictment applies Article 448 paragraph (1) in conjunction with Article 20 letter C of Law Number 1 of 2023, with a maximum penalty of eight years imprisonment.

Meanwhile, the further subsidiarity indictment uses Article 467 paragraphs (1) and (2) in conjunction with Article 20 letter C of Law Number 1 of 2023, with a maximum sentence of seven years imprisonment.

“The application of the indictment subsidiarity is intended to provide alternative proof in the trial, so that the panel of judges has room to assess the actions of the defendants based on the facts revealed,” Andri explained.

Thus, all subsequent processes, including witness examinations, proof, and decisions, will be conducted in an open trial forum, in accordance with applicable provisions.

Previously, the TNI Military Police Centre (Puspom) detained four TNI personnel suspected of involvement in the acid splashing case against the Deputy Coordinator of the Commission for the Disappeared and Victims of Violence (KontraS) Andrie Yunus.

“So now, the four suspects in question have been secured at the TNI Puspom for further investigation to the prosecution level,” said the Commander of the TNI Puspom, Major General TNI Yusri Nuryanto, in Jakarta on 18 March 2026.

The four suspects are now threatened to be charged under Articles 467 paragraphs 1 and 2 of the Criminal Code, with a maximum penalty of 7 years imprisonment.

Yusri assured that the TNI Puspom works professionally and transparently, and ensures that all findings by TNI investigators are presented openly in the trial.
