LPSK Accompanies Santri Victim of Sexual Violence in Probolinggo Until Trial
REPUBLIKA.CO.ID, JAKARTA – The Witness and Victim Protection Agency (LPSK) is providing protection to a santri with the initials FA who is a victim of a criminal act of sexual violence (TPKS) based on power relations at a pesantren in Probolinggo, East Java. This protection includes various services, such as accompaniment during the trial process at the Probolinggo District Court.
During the victim witness examination agenda, LPSK is present directly to ensure that the victim can provide testimony safely and without pressure. This accompaniment is an important part in maintaining the victim’s psychological condition during the ongoing legal process.
Previously, LPSK has determined that victim FA is entitled to receive a protection programme that includes the fulfilment of procedural rights. The programme includes physical protection during the trial, psychological rehabilitation assistance, legal protection, and facilitation of restitution as part of the comprehensive recovery of the victim’s rights.
LPSK Deputy Chair Sri Nurherwati emphasised that the agency’s presence in the courtroom aims to provide a sense of security for the victim. Psychological accompaniment is also provided so that the victim can deliver testimony clearly and calmly.
“LPSK is currently accompanying victims of sexual violence crimes who greatly need protection. The protection programme for TPKS victims based on power relations that occurred in the pesantren environment in Probolinggo is carried out to guarantee security and support the victim’s recovery,” said Nurherwati in her statement on Monday (4/5/2026).
She emphasised the importance of a safe space for victims in undergoing the legal process. According to her, protection for TPKS victims is regulated in Law Number 12 of 2022 on TPKS. In that regulation, it is emphasised that victims, witnesses, reporters, or experts cannot be prosecuted for reports or testimony given as long as they are made in good faith.
“This includes protection from potential criminalisation and social stigma that can hinder recovery and the courage to speak out,” said Nurherwati.
In addition, Law Number 31 of 2014 on Witness and Victim Protection also provides additional guarantees. In Article 10 paragraph (2), it is stated that if there is a legal claim against the victim for the report submitted, then that process must be suspended until the main case obtains a court decision with permanent legal force.
