Yaya Satyanegara emphasised that the main focus of the lawsuit is on the ongoing legal process, not merely on the substance of the diploma. “This means that from the Forum of TNI Retired Officers, we are filing this citizen lawsuit because we feel concerned and disappointed,” Yaya said during a press conference on Sunday (29/3). “It’s almost related, but we’re not talking about the fake diploma, but about law enforcement,” he added. The lawsuit, initiated by nine generals, six colonels, and two citizens, is based on allegations of abuse of power by authorities and negligence by investigators in applying criminal articles. The plaintiffs assess that there has been legal smuggling in the investigation of the case that also involves Roy Suryo and Dr. Tifa. Elaborating further on the essence of the legal action taken, Yaya stated that this citizen lawsuit serves as an instrument to restore public rights harmed by the system. “In the application of law, this is essentially an unlawful act by those in power that harms public rights. This mechanism aims to demand that the government or authorities fulfil their legal obligations, not just to seek material compensation,” he explained. Before the lawsuit was officially registered at the South Jakarta District Court, the retirees claimed to have sent two summonses, on 20 August and 10 November 2025, which went unanswered by the police. Therefore, at the first hearing scheduled for 6 April 2026, the generals will bring several demands for systemic improvements with a purely symbolic financial claim. “To sentence the defendant to pay compensation to the plaintiffs amounting to Rp100,000. We don’t ask for much. The important thing is for the citizen, to bring about a change in policy that we consider negligent,” Yaya stressed. In its petition, these 17 Indonesian citizens request the Panel of Judges to declare that the defendant Ditreskrimum Metro Jaya Police has committed an unlawful act due to negligence or allowing in implementing investigation management policies by registering criminal articles that do not match the reported incident, such as Article 27A, Article 32 paragraph 1, and Article 35 of the ITE Law. “Thus, it also does not meet the principles of good governance and legal principles, so it should be interpreted as smuggling of criminal articles having occurred,” Yaya said.
