List of High-Ranking State Officials Whose Pension Rights Could Be Revoked by Constitutional Court Ruling
Jakarta – Not only members of the House of Representatives (DPR) face potential loss of pension rights through the latest Constitutional Court (MK) ruling, but the following high-ranking state officials could also be affected.
High-ranking state officials impacted by Ruling Number 191/PUU-XXIII/2025, which was handed down on Monday 16 March 2026, include leaders and members of high state institutions.
High state institutions are the State Advisory Council (DPA), the House of Representatives (DPR), the Supreme Audit Board (BPK), and the Supreme Court (MA).
“The President is not included,” according to letter b of Article 1 of the aforementioned law.
The Leaders of High State Institutions as set out in point d of Article 1 of the aforementioned law are as follows:
Chairperson and Vice Chairperson of the DPA
Chairperson and Vice Chairperson of the DPR
Chairperson and Vice Chairperson of the BPK
Chairperson, Vice Chairperson, and Deputy Chairperson of the MA.
The DPA, or State Advisory Council, was a state advisory body that existed in Indonesia from 1945 to 2003. The DPA was abolished through an amendment to the 1945 Constitution in 2002 and replaced by the Presidential Advisory Council (Wantimpres).
Ruling Number 191/PUU-XXIII/2025 affirmed that Law Number 12 of 1980 has conditional legal force only provided that it is replaced with new legislation within a maximum of two years.
The Constitutional Court explicitly called on the DPR and government to formulate new legislation.
