Lawyer Demands TNI Soldiers Who Attacked Andrie Yunus Be Tried in General Court
The TNI’s Military Police has revealed that four BAIS TNI soldiers are the suspected perpetrators of the acid attack on Andrie Yunus, Deputy Coordinator of KontraS. M Fadhil Alfathan, Director of the Jakarta Legal Aid Institute (LBH) and a member of Andrie’s legal team, has demanded that the four soldiers be processed through general court procedures.
Andrie’s legal team is pressing for the suspected perpetrators to be handed over to the general court, as the offence is not related to military crimes and the victim is a civilian.
“(We urge) the President of the Republic of Indonesia to immediately order the TNI Commander to hand over the perpetrators for trial in the general court because the criminal act of planned attempted murder is a common criminal offence, the victim is a civilian, and to ensure the uncovering of the intellectual actors of this incident without favouritism, as well as effective restoration for the victim,” Fadhil told reporters on Wednesday (18/3/2026).
His side views there to be confusion regarding the investigation or prosecution process of the case stemming from differing results in the probes between the TNI and the police. He refers to the TNI Law, stating that soldiers are subject to the general court for violations of general criminal law.
“In the past few days, police investigators have conducted various efforts such as gathering evidence and statements. We view that this case must be processed based on general court procedures,” Fadhil said.
“This is in accordance with Article 3 paragraph (4) of Tap MPR No. VIII of 2000 and Article 65 paragraph (2) of Law No. 34 of 2004 on the TNI, which states that soldiers are subject to military judicial authority in cases of military criminal law violations and to general judicial authority in cases of general criminal law violations as regulated by law,” he explained.
