Land Information Dispute in North Jakarta to Proceed to Mediation
Jakarta (ANTARA) - The hearing for the land information dispute between applicant Saut Maruli Simatupang and respondent North Jakarta Land Office continued to the mediation stage after an initial examination by the DKI Jakarta Provincial Information Commission on Wednesday (25/2).
The hearing was chaired by Chairman of the Commission, Harry Ara Hutabarat, accompanied by commission members Luqman Hakim Arifin and Ferid Nugroho, and Substitute Clerk Elwin Rivo Sani.
Chairman of the Commission, Harry Ara Hutabarat, in a statement in Jakarta on Thursday, said that this dispute is objective and aims to ensure the status of the requested information, whether it is public information or exempt information.
The Commission first examined the legal standing of the parties and stated that both the applicant and the respondent had met the requirements.
The respondent also explained that there had been institutional adjustments following the change in leadership, where the head of the PPID (Public Information Officer) is now the Head of the North Jakarta Land Office.
In the hearing, Saut, as the applicant, explained the chronology of the information request, stating that he is an heir who has a direct interest in the disputed land and has physically possessed the land since 1974.
Commission member Luqman Hakim Arifin emphasised the importance of tracing the history of land ownership and the clarity of the purpose of the requested information.
“There must be clarity on the genealogy of land ownership over time. The requested information also needs to be ensured that its use is in accordance with legal needs,” he said.
Meanwhile, the respondent stated that the requested documents are land documents containing physical data and land measurements as the basis for issuing certificates.
The respondent believes that the documents are exempt information, referring to the Regulation of the Minister of ATR/Head of BPN Number 32 of 2021.
In response to this, Harry Ara Hutabarat said that the exempt information through the consequence test can still be re-evaluated by the head of the PPID.
“The consequence test can still be re-evaluated by the head of the PPID to ensure to what extent the information can be provided or remain exempt,” he explained.
“We hope that mediation can bring a win-win solution for both parties,” he said.
