Komnas HAM to Investigate Mobile Brigade Officer's Fatal Assault of Student in Tual
Jakarta (ANTARA) - The National Commission on Human Rights (Komnas HAM) of the Republic of Indonesia will soon conduct an on-site investigation into the case involving a member of the Mobile Brigade (Brimob) allegedly assaulting a junior high school student to death in Tual, Maluku. Komnas HAM Chairman Anis Hidayah, in an interview at the Komnas HAM office in Jakarta on Tuesday, explained that the investigation would be carried out to strengthen the monitoring that had already been conducted by Komnas HAM representatives in Maluku. “Komnas HAM, through its representatives in Maluku, has coordinated, conducted on-site visits, and also followed the ethical hearing process, but Komnas HAM RI will also soon conduct an on-site visit,” Anis told ANTARA. Komnas HAM will then gather information from various parties. Anis assured that the results of the investigation would be made public. “We will inform you later about who we need to summon, who we need to meet, and what data and information we need to obtain during the on-site visit,” Anis said. Anis further emphasised that the sanction of dismissal from the force imposed on the suspect, Bripda Mesias Viktor Siahaya (MS), was not enough. “An accountable and transparent criminal legal process is needed against the individual in question to prevent impunity,” he added. The decision was made during the Commission Hearing of the Indonesian National Police’s Code of Ethics (KEPP), which lasted for 14 hours, from Monday (23 February) at 2:00 PM local time to Tuesday at 3:00 AM. A total of 14 witnesses were examined during the hearing, including the alleged perpetrator. Ten witnesses were present in the courtroom, consisting of nine Brimob members and one sibling of the victim. The hearing found that Bripda MS had committed an unethical act and violated the Code of Ethics of the Indonesian National Police. However, the individual has stated that he needs time to consider the panel’s decision and has been given time to file an appeal. Previously, the Tual Police in Maluku had also named Bripda MS as a suspect in this case. He was charged under Article 76C in conjunction with Article 80 paragraph (3) of Law Number 35 of 2014 on Child Protection, with a maximum penalty of 15 years in prison. In addition, the suspect was also charged under Article 466 of Law Number 1 of 2023 on the National Criminal Code, related to assault resulting in death, with a maximum penalty of seven years in prison.
