Kalideres Residents sue West Jakarta Mayor to the Administrative Court over Crematorium Permit

JAKARTA, KOMPAS.com – Kalideres residents have filed a lawsuit against West Jakarta City Mayor Iin Mutmainnah over the grant of the Building Permit Approval (PBG) for the Swarga Abadi crematorium project. The residents filed at the Jakarta Administrative Court (PTUN) Jakarta because they believe the permit violates Regional Regulation (Perda). Coordinating figure Budiman Tandiono of the Citra Garden 2 residents group confirmed the case, number 83/G/2026/PTUN JKT, directly targeting the leadership of the West Jakarta City Government. Budiman said the legal move was taken since last week and is now officially registered in court. ‘Yes, yesterday we residents of Kalideres and Pegadungan refused the construction of the funeral home and crematorium; we have registered a suit at PTUN over the permit for the project. The object of the suit is the Building Permit (PBG) letter now held by the developer, though it does not yet have an environmental permit. The legal basis cited by the residents is Regional Regulation (Perda) No. 3 of 2007 on Burial, specifically Article 7(a), which prohibits the establishment of crematorium facilities in densely populated settlements. ‘Yes, the suit concerns the PBG. Because the grant of the PBG and the construction contravene the rules, contravene the Perda, which prohibits building in densely populated areas,’ Budiman said. The legal step is taken collectively under the banner of the RW (Rukun Warga) administrators whose areas directly border the project site. After the suit was registered, the residents are now preparing to face representatives of the West Jakarta City Government in court.
