JPPI Demands Government Implement Free Private School Policy One Year After Constitutional Court Ruling

JAKARTA, KOMPAS.com – Ubaid Matraji, National Coordinator of the Indonesian Education Monitoring Network (JPPI), has called on the government to implement the Constitutional Court’s ruling on free private schools under Decision No. 3/PUU-XXII/2024.

Despite the ruling being in effect for a year, the policy on free private schools has yet to be realised by the public.

JPPI is urging President Prabowo Subianto to issue implementing regulations for the Constitutional Court’s decision.

“JPPI’s demand is for the President to promptly issue implementing regulations (Presidential Regulation or Government Regulation) to enforce the Constitutional Court’s ruling on free basic education in private schools to end discrimination,” he stated in a written statement on Monday, 25 May 2026.

JPPI also wants budget reallocation from inefficient programmes, such as free nutritious meals (MBG), towards education funding.

Additionally, the group has requested local leaders to issue emergency discretion for the 2026 New Student Admission Selection (SPMB) to ensure full funding for students forced into private schools due to limited public school quotas through regional budget mechanisms.

The court’s ruling stated that Article 34(2) of Law No. 20 of 2003 on the National Education System (Sisdiknas), published in State Gazette No. 78 of 2003 and Additional State Gazette No. 4301, is unconstitutional.
