Jakarta, VIVA – The House of Representatives (DPR) held its 14th plenary session to close the third session period of the 2025-2026 parliamentary year on Thursday, 19 February 2026. The session was chaired by DPR Speaker Puan Maharani.

Also present at the plenary session were other DPR leaders, namely Deputy Speakers Saan Mustopa, Cucun Ahmad Syamsurijal, Sufmi Dasco Ahmad, and Sari Yuliati.

During the session, the DPR declared that the Constitutional Court Ethics Council (MKMK) has no authority to follow up on reports concerning the selection process for Constitutional Court justices.

This includes the selection of Adies Kadir by the DPR as a Constitutional Court justice.

Puan read out the conclusions that had been agreed upon by all members of DPR Commission III. It was stated that the MKMK does not have the authority to investigate the report.

“Commission III of the DPR affirms that the authority to select Constitutional Court justices by the DPR is a constitutional mandate, as stipulated in Article 24C paragraph 3 of the 1945 Constitution. Therefore, the Constitutional Court Ethics Council does not have the authority to follow up on reports related to the mechanism for selecting Constitutional Court justices by all nominating institutions, including that carried out by the DPR in respect of Prof. Dr. Adies Kadir SH, M.Hum,” said Puan.

Furthermore, the DPR also requested that the MKMK carry out its duties in accordance with its authority as regulated under Article 27a of Law No. 7 of 2020 concerning the Constitutional Court. Based on that article, Puan said, the MKMK’s duties are limited solely to enforcing the code of ethics and conduct of sitting justices.

The DPR also recommended that the Constitutional Court clarify the duties and functions of the MKMK.

“Commission III of the DPR recommends that the Constitutional Court clarify the regulations regarding the duties, functions and authority of the MKMK so that they are in accordance with the mandate of Law No. 7 of 2020 concerning the Constitutional Court,” said Puan.

It is known that 21 professors, lecturers and legal practitioners affiliated with the Constitutional and Administrative Law Society (CALS) had reported Constitutional Court Justice Adies Kadir to the MKMK.

Adies Kadir was reported because his nomination as a Constitutional Court justice proposed by the DPR was alleged to have violated the code of ethics and guidelines on conduct for Constitutional Court justices as well as prevailing legislation. The report was said to have been filed in order to safeguard the dignity and honour of the Court.
