Chairman of Commission III of the Indonesian House of Representatives, Habiburokhman, affirmed that his commission will not interfere in the drug case involving Fandi Ramadhan, a crew member of the Sea Dragon, which is currently being tried at the Batam District Court.

He emphasized that the DPR’s oversight function is regulated in Article 20A paragraph 1 of the 1945 Constitution, where Commission III is obliged to respond to cases that touch on public justice without interfering with the technical aspects of the law.

“Commission III clearly does not interfere technically with cases that are being handled by law enforcement officials. However, our obligation is to ensure that the tasks of our partners are in accordance with the applicable legal provisions,” said Habiburokhman at the Parliament Complex, Senayan, Thursday (February 26, 2026).

The Gerindra Party politician regretted the statement by an unnamed public prosecutor at the Batam District Court, who implicitly stated that the DPR was interfering in the case. He requested that the Deputy Attorney General for Supervision issue a reprimand.

“It is not only the DPR that can express its opinion, the public can also do so through amicus curiae. This is regulated in Article 5 paragraph 1 of the Law on Judicial Power, where judges are obliged to explore public justice, not just assess the facts of the trial,” he said.

Habiburokhman also reminded that the latest Criminal Code places the death penalty as an alternative punishment and a last resort. He asked that its application be carried out very selectively.

“We appreciate the Attorney General and the National Police Chief who have been responsive to previous cases. For the Fandi Ramadan case, we reiterate that the death penalty must be applied selectively as stipulated in the Criminal Code,” he added.

Fandi Ramadhan was previously tried at the Batam District Court on charges of smuggling 1,995,130 grams or almost 2 tons of methamphetamine and was sentenced to death by the public prosecutor.

The Head of the Legal Information Center of the Attorney General’s Office, Anang Supriatna, affirmed that the demand was based on legal facts and evidence revealed at trial.

“Therefore, on February 5, 2026, the six defendants were prosecuted and each was sentenced to death. Of course, the public prosecutor in carrying out the prosecution is based on legal facts and evidence revealed at trial,” he said, Friday (February 20).
