Home Buyers in Tangsel Bricked Up, Said Not to Have Paid in Full Since 2019, Set to Be Sued by Owner
A property sale dispute that culminated in the bricking up of access to a house on Jalan Murjaya, Jurang Mangu Barat Ward, Pondok Aren, South Tangerang, has entered a new phase.
The homeowner is threatening to sue the buyers for alleged breach of contract, while the occupants claim to have paid the majority of the transaction value.
The homeowner’s legal representative, Karnadi, stated that they will file a breach of contract lawsuit because the buyers have not settled the payments since the initial agreement in 2019.
Ridho explained that his client sold the house for Rp1.3 billion to Desi Riana. However, payments to date are said to have reached only Rp570 million.
“Desi Riana did not fulfil the obligation to pay Rp1.3 billion within the three-month period as per the oral sales agreement between the parties,” he said.
According to Ridho, ownership of the house remains with Karnadi because the transaction has not been formalised with a Sale and Purchase Deed (AJB). He noted that the transfer of land rights is only valid if documented in an AJB prepared by a Land Deed Official (PPAT).
“Legally, without an AJB, ownership has not transferred. The certificate is still in our client’s name,” he clarified.
He also mentioned that they had sent two summonses to the buyers, on 1 April and 7 April 2026, demanding full payment or vacation of the property. However, these summonses were reportedly ignored.
“We sent the summonses to seek an amicable resolution, but there was no response,” Ridho said.
Consequently, they visited the site, removed the occupants’ belongings, and bricked up the house access. According to Ridho, this action was an effort by his client to protect their legal rights over the asset.
“What we did was not an execution, but a vacation of the property. And that is because the object still belongs to our client,” he said.
“We have the payment receipts from the beginning, complete, from 2019,” said Raffa Azman when met by Kompas.com at the location on Monday (21/4/2026).
Raffa explained that his family began instalments on the house in 2019 with a down payment of Rp200 million. By 2021, the total payments had reached Rp840 million.
According to him, the sale process did not include a Sale and Purchase Deed (AJB) because it was based on trust between his family and the homeowner. Additionally, his family provided an extra Rp60 million, said to be for certificate processing.
Raffa stated that the house certificate is still combined and has not been split from the four other adjacent house units.
Raffa said his family had intended to settle the remaining payment. However, the settlement has not been made because the house certificate has not been handed over by the seller.
