High Court Judge in Central Sulawesi Dismissed for Assaulting Intoxicated Son Requiring Hospital Admission

The Judicial Commission (KY) and Supreme Court (MA) have held a Judicial Honour Board (MKH) hearing against AJK, a judicial judge at the High Court of Central Sulawesi (PT Sulteng). The MKH has ruled to dismiss AJK from his position as judge.

According to the KY’s official website on Friday 13 March 2026, the MKH hearing was held on Tuesday 10 March. The dismissal sanction is lighter than the Supreme Court’s Supervisory Board’s recommendation for dishonourable discharge.

AJK has been found guilty of domestic violence. He was convicted of assaulting his son AI in 2023.

“Revising the Memorandum from the Head of the Supreme Court’s Supervisory Board against the respondent AJK into a heavy sanction consisting of dismissal from the position of judge, as regulated in Article 19 Paragraph (4) of the Joint Regulation of the Supreme Court of the Republic of Indonesia and Judicial Commission of the Republic of Indonesia Number 02/PB/MA/IX/2012-02/PB/P.KY/09/2012 concerning Guidelines for Enforcement of Judicial Code of Conduct and Judicial Behaviour Standards,” said Prim Haryadi, Head of the MA’s Criminal Division and Chair of the MKH.

The MKH stated that the incident began when victim AI and witness AA, both children of AJK from his previous marriage to EI, returned home late at night in 2023. AJK then reprimanded his two children, leading to an altercation.

The MKH noted that AI, who was under the influence of alcohol, then grabbed a machete still in its sheath. During the struggle, the machete struck AI’s head.

Witness EC, AJK’s wife, found AI bleeding and took him to hospital. While hospitalised, AI video-called his biological mother EI.

When EI saw her son’s bleeding head, she immediately travelled to Kendari to report AJK to the local police station. EI acknowledged that she had only heard AI’s account and immediately reported her ex-husband.

After hearing statements from AA and EC, two weeks later EI withdrew the report. AJK admitted he had attempted to guide his son and did not believe his actions were correct, expressing remorse.

The Indonesian Judges Association (IKAHI) representative argued in defence that the matter had actually been settled peacefully. The case allegedly became prolonged due to interference from EI’s former legal adviser, who was said to be attempting extortion of AJK.

When not complied with, EI’s former legal adviser subsequently went viral with the incident. This statement was confirmed by EI.

IKAHI in its defence stated that AJK had made efforts to prevent his children from falling into promiscuity. IKAHI noted that AJK had a family requiring financial support.

Based on this, the MKH believed that AJK’s defence memorandum and submitted evidence did not constitute new matters and did not mitigate AJK’s credibility. The board believed there was no guarantee the respondent would not repeat his actions.

AJK has been found to have received sanctions four times previously, including a two-year suspension from judicial work. The board then considered AJK’s circumstances of supporting one wife and five children, so AJK’s defence was partially accepted.

Other MKH members consisted of Justices Lulik Tri Cahyaningrum and Sutarjo. The KY was represented by KY members Abhan, F Williem Saija, Setyawan Hartono, and Andi Muhammad Asrun.
