First Hearing in Assault Case Against KontraS Activist Scheduled for 29 April
Jakarta (ANTARA) - The Military Court II-08 in Jakarta has scheduled the first hearing in the alleged assault case against Commission for the Disappeared and Victims of Violence (KontraS) activist Andrie Yunus for Wednesday, 29 April 2026.
“On that basis, we considered Wednesday. Therefore, for now, we have scheduled the inaugural hearing for Wednesday, 29 April 2026,” said the Head of Military Court II-08 Jakarta, Colonel Chk Fredy Ferdian Isnartanto, after the handover of the case file and evidence in the alleged assault against KontraS activist Andrie Yunus to the Military Court II-08 Jakarta on Thursday.
The first hearing, he said, will agenda the reading of the indictment against the defendants, who are active military members.
He mentioned that the scheduling of the hearing was done after his side received and examined the case file forwarded by the Military Prosecutor’s Office II-07 Jakarta.
“After receiving the case file, it becomes the court’s authority. We first examine and investigate whether this case falls under our jurisdiction to be tried,” Fredy stated.
He explained that from the aspect of absolute jurisdiction, the case meets the elements because the defendants are military members.
There are four defendants recorded in the case, all of whom hold the status of active soldiers, thus the subjects are under military court jurisdiction.
In addition, from the aspect of relative jurisdiction, the location of the incident around Cipto Mangunkusumo Hospital, Salemba, Central Jakarta, also strengthens that the case falls under the jurisdiction of the Jakarta Military Court.
“The locus is in Jakarta, specifically in the Salemba area, so it falls under our relative jurisdiction. Moreover, the units of the defendants are also within the legal territory of the Military Court II-08 Jakarta,” Fredy clarified.
Furthermore, he revealed that after the file is declared to meet the requirements, the court immediately registers the case.
According to procedure, the examination and registration process is carried out in a short time, even just one day.
“If there are no formal or material deficiencies, the file is immediately registered by us. After that, in accordance with the standard operating procedure (SOP), the hearing must be held at the latest 10 days ahead,” Fredy said.
Referring to the registration time planned for 17 April 2026, the actual hearing schedule could be held around 27 April.
However, the court considered various technical factors, including potential scheduling conflicts with other ongoing cases.
“We check the schedule to avoid clashes with other cases, including the Jakarta branch bank manager case taking place early in the week. In addition, we also adjust to the joint hearing pattern with the Military Prosecutor’s Office,” Fredy explained.
He added that coordination with the Military Prosecutor’s Office is also an important consideration, particularly regarding the status of the defendants who are currently detained. Based on the prevailing pattern, hearings with detained defendants are usually held on Mondays and Wednesdays.
The Military Court II-08 Jakarta also ensures that the trial process will be open to the public. The public, including the media, is welcome to follow the proceedings to ensure transparency in the legal process.
“The hearing is open to the public, just like in district courts. The public and media are welcome to come and monitor the hearing,” Fredy revealed.
Nevertheless, he acknowledged limitations in the courtroom capacity. Therefore, his side is preparing several supporting facilities to accommodate public interest.
Fredy also emphasised that since the case file was forwarded to the court, the authority over the file, evidence, and detention has shifted to the Military Court II-08 Jakarta.
However, the process of summoning witnesses and defendants remains the authority of the Military Prosecutor’s Office.
“The court is authorised to hold the hearing and set the schedule. Meanwhile, summoning witnesses and defendants is still done by the Military Prosecutor’s Office,” Fredy said.
As is known, the Military Court II-08 Jakarta officially received the case file for the alleged assault against KontraS activist Andrie Yunus from the Military Prosecutor’s Office II-07 Jakarta.
After the case file is received, the next stage is the appointment of the panel of judges who will examine and adjudicate the case.
The four previously held suspect status and now officially become defendants after the case file was forwarded to the court.
The case is registered under number 55/K/207/AL-AU/IV/2026 dated 13 April 2026. The file includes evidence, four defendants, and eight witnesses to be presented at the hearing.
Of the eight witnesses, five are military members, while the other three are from civilian circles.
In the indictment construction, the Military Prosecutor applies a layered or subsidiary indictment system against the defendants. For the primary indictment, the defendants are charged under Article 469 paragraph (1) of the Criminal Code jo Article 20 letter C of Law Number 1 of 2023 with a maximum penalty of 12 years’ imprisonment.
The subsidiary indictment is applied under Article 448 paragraph (1) juncto Article 20 letter C of Law Number 1 of 2023 with a maximum penalty of eight years’ imprisonment.
Meanwhile, the further subsidiary indictment uses Article 467 paragraphs (1) and (2) juncto Article 20 letter C of Law Number 1 of 2023 with a maximum sentence of seven years’ imprisonment.
Previously, the Military Prosecutor’s Office II-07 Jakarta handed over 11 pieces of evidence related to the alleged assault case against KontraS activist Andrie Yunus, along with the forwarding of the case file to the Military Court II-08 Jakarta.
The evidence handed over includes one tumbler glass, one pair of glasses, one white T-shirt, one pair of shoes, one pair of trousers, one shirt, one black helmet.
