Fictive Positive Principle Applied as Bureaucratic Reform Breakthrough in Business Licensing
Todotua conveyed this before regional heads and deputy regional heads attending the Second Wave of Regional Head and Deputy Regional Head Leadership Orientation at the Institute of Domestic Governance (IPDN) campus in Jatinangor, Sumedang Regency, West Java, on Wednesday, 25 June 2025.
Fictive Positive is a principle within the business licensing system which states that if a licensing application that has fulfilled all requirements does not receive a response or decision from the relevant authority within the specified timeframe in accordance with the Service Level Agreement (SLA), the application is automatically deemed approved and legally valid.
"Fictive Positive is implemented as a bureaucratic reform breakthrough to improve the efficiency and transparency of licensing services," said Todotua in a press release quoted on Monday, 30 June 2025.
Todotua emphasised the importance of the role of regional heads and their apparatus in driving investment to boost the economy. According to Todotua, the retreat served as an important moment for direct interaction with regional governments regarding investment development.
Todotua said regional governments hold a key role in supporting investment growth, particularly through the Investment and One-Stop Integrated Services Agency (DPMPTSP), which is tasked with handling investment matters.
"This forum is one that we have personally been looking forward to, as it provides a moment for us to meet face to face. Our ministry is one that will interact extensively with your functions at the provincial, regency and city levels," said Todotua.
Todotua expressed hope for strong collaboration between the central government and regional governments in handling investment. The Ministry of Investment and Downstreaming/BKPM also opened opportunities for regional governments wishing to consult on investment matters.
"All licensing is managed within a single OSS platform, and the control lies with us. This is the moment, because we also want coordination between the central and regional governments to move quickly," Todotua said.
