Factors Aggravating the 15-Year Prison Sentence for Riza Chalid's Son
The son of fugitive Riza Chalid, Muhamad Kerry Adrianto Riza, has been sentenced to 15 years in prison. A key factor in the sentencing was the defendant’s lack of support for the government’s ongoing efforts to combat corruption.
“An aggravating circumstance is that the defendant’s actions did not support the government’s vigorous efforts to eradicate corruption,” said the head of the panel of judges, Fajar Kusuma Aji, while reading the verdict at the Jakarta Central Corruption Court on Friday (27/2/2026).
Meanwhile, mitigating circumstances include the fact that Kerry had no prior convictions and has family responsibilities.
The judge also ordered Kerry to pay a fine of IDR 1 billion, which must be paid within one month and can be extended for a maximum of one month from the date the verdict becomes legally binding.
The judge stipulated that if the fine is not paid within the specified period, the defendant’s assets or income may be seized and auctioned to pay the fine.
“In the event that the proceeds from the seizure or auction of assets or income are insufficient or impossible to execute, the unpaid fine will be replaced with a prison sentence of 190 days,” the judge said.
In addition, Kerry was also sentenced to additional penalties, including paying restitution of IDR 2,905,420,003,854, with a subsidiary sentence of 5 years in prison.
The verdict was not unanimous, as Judge Mulyono Dwi Purwanto had a dissenting opinion. Judge Mulyono questioned the procedure for calculating the amount of financial or economic losses in this case.
Judge Mulyono also argued that there was no malicious intent in the tank rental. He also stated that the tank was still in use and provided significant benefits to the country.
“Given these circumstances, the panel member believes that it is unfair for the defendants from PT OTM to be tried and convicted,” said Judge Mulyono.
The judge stated that Kerry Adrianto was found guilty of violating Article 603 in conjunction with Article 20 paragraph C of Law Number 1 of 2023 concerning the Criminal Code (KUHP) in conjunction with Article 18 of the Corruption Law.
Previously, the Public Prosecutor (JPU) had demanded a sentence of 18 years in prison for Kerry Adrianto, a fine of IDR 1 billion or 190 days of detention. The prosecutor also demanded that Kerry pay restitution of IDR 13,405,420,003,854, with a subsidiary sentence of 10 years of detention.
