Draft MPR Decree on the Popular Consultation in East Timor
ALTERNATIVE ONE
Article 1
The People's Consultative Assembly of the Republic of
Indonesia in essence acknowledges the result of the popular
consultation held by UNAMET in East Timor on Aug. 30, 1999.
Article 2
(1) Assigns the President of the Republic of Indonesia to:
a. follow up reports on suspicions of impartiality by the UN
Mission in East Timor (UNAMET) in executing the popular
consultation as mentioned in Article 1.
b. conduct diplomatic action, under the auspices of the United
Nations, to jointly detach East Timor from the Constitution
or legislation of Portugal.
c. to temporarily delay the transfer of rule over East Timor
as mentioned in Article 6 of the New York May 5, 1999
Agreement until the conditions as set out in points (a) and
(b) of the article are satisfied.
(2) Assign the president of the Republic of Indonesia to take
concrete steps to provide protection to the East Timorese as a
consequence of the result of the popular consultation mentioned
in Article 1 of this decree.
Article 3
Assign the President of the Republic of Indonesia to
enduringly maintain the solidarity of the unitary state of the
Republic of Indonesia for the unity and oneness of the people of
Indonesia.
Article 4
(1) Postpone the revocation of Decree No. VI/MPR/1978 on the
formal unification of the East Timor territory as part of the
unitary state of the Republic of Indonesia until Article 2 of
this decree is carried out.
(2) The establishment of the revocation of Decree No. VI/MPR/1978
on the formal integration of the East Timor territory as part of
the unitary state of the Republic of Indonesia shall be conducted
during the annual session or Special Session of the MPR during
its 1999/2004 tenure.
Article 5
This decree shall take effect on the date it is enacted
ALTERNATIVE TWO
Article 1
The People's Consultative Assembly of the Republic of
Indonesia acknowledges the result of the popular consultation
held by UNAMET in East Timor on Aug. 30, 1999.
Article 2
Orders the president of the Republic of Indonesia to conduct
talks with the United Nations to follow up on suspicions of
impartiality by UNAMET in executing the popular consultation as
mentioned in Article 1 of this decree.
Article 3
Orders the president of the Republic of Indonesia to:
a. conduct diplomatic action, under the auspices of the United
Nations, to jointly detach East Timor from the Constitution
or legislation of Portugal;
b. to follow up the results of the popular consultation in
accordance with the results of the tripartite agreement
between Indonesia, Portugal and the United Nations;
c. together with relevant international organizations take
concrete steps to provide protection for East Timorese as a
consequence of the results of the popular consultation as
mentioned in Article 1 of this decree.
Article 4
Assign the president of the Republic of Indonesia to
enduringly maintain the solidarity of the unitary state of the
Republic of Indonesia for the unity and oneness of the people of
Indonesia.
Article 5
(1) Declare Decree No. VI/MPR/1978 on the formal integration of
the East Timor territory as part of the unitary state of the
Republic of Indonesia as void;
(2) The revocation of Decree No. VI/MPR/1978 on the formal
integration of the East Timor territory as part of the unitary
state of the Republic of Indonesia as mentioned in Paragraph (1)
does not invalidate any form of recognition awarded by the state
on the fighters and government apparatus while the territory of
the province of East Timor was part of the unitary state of the
Republic of Indonesia.
Article 6
All matters connected to the separation of the territory of
East Timor from the unitary state of the Republic of Indonesia
will be further sanctioned in accordance to applicable laws.
Article 7
This decree will take effect on the date it is enacted.
