The draft law on taxation which the government is planning to
submit to the House of Representatives (DPR) contains, among
other things, the recommendation that the State Administrative
Court be declared incompetent to handle complaints filed by
taxpayers concerning warrants issued by the tax authorities to
collect taxes in arrears.
Giving the tax authorities the right to issue warrants would
make them extremely powerful with respect to collecting taxes
that are owed on the basis of the tax forms that are also issued
by them.
The government's proposal to stipulate that tax payers cannot
file a complaint with the State Administrative Court is therefore
superfluous. The House should reject this proposal. Let the
Administrative Court decide whether or not the warrants in
question have any proper legal ground.
