DPR Plenary Session Declares MKMK Has No Authority to Process Report on Adies Kadir
The 14th DPR Plenary Session marking the close of the third sitting period announced the results of Commission III’s meeting with the Constitutional Court’s Ethics Council (Majelis Kehormatan Mahkamah Konstitusi/MKMK) regarding a report on alleged ethical violations in the appointment of Constitutional Court Justice Adies Kadir.
The findings were contained in a letter from the Commission III leadership, numbered B/117/PW.01/2/2026 dated 18 February 2026, concerning the submission of Commission III’s conclusions to be read out at the plenary session.
Among its key conclusions, the meeting affirmed that the MKMK was deemed to lack the authority to follow up on reports related to the mechanism for selecting constitutional court justices by the three nominating institutions, including the DPR, which nominated Adies Kadir.
“Therefore, the MKMK does not have the authority to follow up on reports related to the mechanism for selecting constitutional court justices by all nominating institutions, including that carried out by the DPR for Prof. Dr. Ir. Adies Kadir, S.H, M.Hum,” said Speaker Puan Maharani, reading out the meeting’s conclusions at the closing plenary session.
Commission III called on the MKMK to remain consistent in exercising its authority under Article 27A of Law Number 7 of 2020 on the Constitutional Court. The law limits the MKMK’s duties solely to enforcing the code of ethics and conduct of sitting constitutional court justices.
Thirdly, Commission III recommended that the Constitutional Court clarify the regulations governing the duties, functions, and authority of the MKMK to ensure alignment with the mandate of Law Number 7 of 2020 on the Constitutional Court.
“We now ask this honourable session whether the conclusions of the Commission III meeting can be approved and followed up in accordance with prevailing mechanisms?” said DPR Speaker Puan Maharani, who chaired the session.
“Agreed,” responded the plenary participants in unison.
The previous day, Commission III members had unanimously grilled the MKMK over allegations that it had processed a report concerning Adies Kadir’s appointment. They questioned the MKMK’s authority to process such a report.
Adies is a DPR-nominated Constitutional Court justice who replaced Arief Hidayat, who reached retirement age in early February.
