Deputy Investment Minister Introduces Fictive Positive Principle for Business Licensing System
JAKARTA - Deputy Minister of Investment and Downstreaming/Deputy Head of BKPM Todotua Pasaribu introduced the Fictive Positive (FikPos) principle, which began implementation in the risk-based Online Single Submission (OSS) business licensing system from early June 2025.
Todotua presented the concept to regional heads and deputy regional heads participating in the second wave of the Regional Leadership Orientation programme at the Institute of Domestic Governance (IPDN) campus in Jatinangor, Sumedang Regency, West Java, on Wednesday (25/6/2025).
Fictive Positive is a principle within the business licensing system whereby if a licence application that has fulfilled all requirements does not receive a response or decision from the relevant authority within the prescribed timeframe in accordance with the Service Level Agreement (SLA), the application is automatically deemed approved and legally valid.
The Fictive Positive principle has been enacted as a bureaucratic reform breakthrough to improve efficiency and transparency in licensing services.
On this occasion, Todotua emphasised the importance of regional heads and their apparatus in driving investment to boost the economy. The retreat served as an important moment for direct interaction with regional governments regarding investment development.
According to him, regional governments hold a key role in supporting investment growth, particularly through the Investment and One-Stop Integrated Services Agency (DPMPTSP), which is tasked with handling investment matters.
"This forum is one we have personally been looking forward to because it provides a moment for us to meet face to face. Our ministry is one that will interact extensively with the functions of regional leaders at the provincial, regency and city levels," said Todotua.
Todotua expressed his hope for strong collaboration between the central government and regional governments in managing investment. The Ministry of Investment and Downstreaming/BKPM also opened opportunities for regional governments wishing to consult on investment matters.
"All licensing is managed within a single OSS platform, and we hold the controls. This is the moment because we also want coordination between the central and regional governments to move swiftly," he said.
