Constitutional Court Judge "Amused" by Mobile Operators' Explanations on Expiring Quotas
JAKARTA, KOMPAS.com - Constitutional Court Judge Arsul Sani admitted to being amused upon hearing various explanations from mobile operators during the hearing on the “expiring quota” case in the material examination of the Telecommunications Law, under case numbers 33/PUU-XXIV/2026 and 273/PUU-XXIII/2025.
Initially, Arsul Sani expressed thanks for the testimonies provided by the relevant parties, namely the mobile operators and PLN, in the hearing held on Monday (4/5/2026).
He then stated, “I am just amused.”
What amused Arsul was the mobile operators’ statements regarding the rollover scheme or quotas without an expiry date potentially causing network congestion or network jamming.
“There are products from the mobile operators, right (rollover products), and indeed there are actual products with internet data rollover,” he said.
Arsul then asked how these operators manage to avoid the network congestion mentioned earlier.
He stated that the Constitutional Court understands the potential for network congestion if this petition is granted.
“How do you manage it, roughly, so there’s a picture of it. Although, of course, we will also delve deeper if there are experts submitted in this case,” he emphasised.
Regarding network congestion, it was explained by the legal representative of the All-Indonesia Mobile Telecommunications Providers Association (ATSI), Adnial Roemza, in the same hearing.
