Al Amin Maksum, a motorcycle taxi driver based in Pandeglang Regency, Banten, has been named a suspect following an accident caused by damaged road conditions on Tuesday, 27 January 2026.

He was designated a suspect after the passenger he was carrying, Khairi Rafi, died as a result of an attempt to avoid a pothole.

Initially, he and Rafi were travelling along the Pandeglang-Labuan main road, specifically in Kampung Gardu Tanjak, Pandeglang Subdistrict, Banten.

During the journey, after attempting to avoid several potholes, the front wheel of the motorcycle he was riding fell into a hole in the damaged road.

He and his passenger were thrown onto the asphalt. At the same time, an ambulance was passing by and ran over the passenger, who died in the incident.

As a result, Al Amin Maksum was charged under Article 310 paragraph 4 of the Criminal Code for causing the death of another person.

In response, the suspect’s legal counsel, Raden Elang Mulyana, filed for case dismissal through the restorative justice mechanism as stipulated in Law Number 20 of 2025 on the Criminal Procedure Code, Chapter IV, Article 79.

He argued the case should not proceed because both the motorcycle taxi driver and the passenger were victims of damaged roads in Pandeglang Regency, Banten.

“The fact is that our client is a victim of an accident caused by a pothole. The party that should be held accountable is the road operator,” said the suspect’s legal counsel, Raden Elang Mulyana, on Monday (23/2).

Pandeglang Police said they were prepared to facilitate restorative justice between Al Amin Maksum and the family of the victim, Khairi Rafi.

“There is agreement from both the victim’s family and the suspect, but formal requirements must be met as we are merely acting as mediators,” said Pandeglang Police Traffic Unit Chief AKP Burhanudin Surya Muhamad on Monday (23/2).

If the motorcycle taxi driver’s family and the victim’s family agree to reconcile, the process will be conducted at the police station.

Once the restorative justice requirements are fulfilled, the legal proceedings can be considered concluded between the suspect and the passenger victim’s family.

“If all those requirements are met, we are ready to proceed, because we want the best outcome for both parties and have no ulterior motives, as we want to stay on track,” he said.
