Central Jakarta District Court Judges Convert Detention of Delpedro and Co-Defendants to City Arrest

The panel of judges has converted the detention status of defendants in an alleged incitement case — Lokataru Executive Director Delpedro Marhaen, @gejayanmemanggil administrator Syahdan Husein, and Lokataru Foundation staff member Muzaffar Salim — from remand detention to city arrest. Delpedro and his co-defendants are subject to mandatory reporting obligations and are prohibited from leaving the city without permission.

“It is confirmed that the Panel of Judges at the Central Jakarta District Court has ordered the conversion of detention for the three defendants from remand detention to city arrest on 13 February 2026, pursuant to Article 108 of Law Number 20 of 2025 on the Criminal Procedure Code,” said Central Jakarta District Court spokesperson Sunoto in a statement on Monday (16/2/2026).

Sunoto stated that what was granted in this case was a conversion of detention, meaning Delpedro and his co-defendants remain in custody. He said Delpedro and the others are required to attend all subsequent hearings in accordance with the panel’s ruling.

“It must be emphasised that a conversion of detention is not a release. The defendants remain in custody with obligations to report regularly, not to leave the city without permission, and to attend every hearing. The trial will continue as scheduled,” he said.

Previously, the panel of judges had already converted the detention of another defendant in the case, University of Riau student Khariq Anhar. The judges took into consideration health factors and trauma experienced by Khariq.

In converting the detention of Delpedro, Syahdan, and Muzaffar, the panel of judges considered a number of different grounds. The details are as follows:

  1. Delpedro Marhaen Rismansyah — on educational grounds. He is an active student in a Master’s programme currently completing his thesis with a deadline of May 2026.

  2. Muzaffar Salim — on grounds of family responsibility. He is caring for elderly parents, with his mother suffering from heart disease and requiring regular medical check-up accompaniment.

  3. Syahdan Husein — on health grounds. He has a mental disability requiring regular psychiatric consultations.

“All applications were accompanied by supporting documents and written guarantees from family members,” said Sunoto.

The Charges

Delpedro, Muzaffar, Syahdan, and Khariq are charged with incitement in connection with demonstrations that turned violent in August 2025. Prosecutors stated the incitement was carried out by Delpedro through the uploading of images and narratives on social media.

“Those who committed, ordered the commission of, and participated in the deliberate and unauthorised distribution and/or transmission of electronic information and/or electronic documents of an inciting nature, inviting or influencing others to generate hatred or hostility towards certain individuals and/or groups of society based on race, nationality, ethnicity, skin colour, religion, belief, gender, mental disability, or physical disability,” said the prosecutor when reading the indictment.

Prosecutors stated that Delpedro, Muzaffar, Syahdan, and Khariq created or joined social media groups to establish intensive communication with parties aligned with their views. Police reportedly found 80 social media posts deemed to be inciting, with the aim of generating hatred towards the government, disseminated by Delpedro and his co-defendants on Instagram between 24 and 29 August 2025.

Prosecutors said the consistent use of hashtags such as #indonesiagelap, #gejayanmemanggil, and #bubarkandpr across all posts created a coordinated campaign that was easily discoverable and trackable by algorithms as a trending topic. Prosecutors stated the posts incited the unrest at the end of August.

Prosecutors have charged Delpedro, Muzaffar, Syahdan, and Khariq with violating Article 28 paragraph 2 in conjunction with Article 45A paragraph 2, or Article 28 paragraph 3 in conjunction with Article 45A paragraph 3 of Law Number 11 of 2008 on Electronic Information and Transactions, in conjunction with Article 55 paragraph 1 point 1 of the Criminal Code; or Article 160 of the Criminal Code in conjunction with Article 55 paragraph 1 point 1 of the Criminal Code; or Article 76H in conjunction with Article 15 in conjunction with Article 87 of Law Number 35 of 2014 on Child Protection, in conjunction with Article 55 paragraph 1 point 1 of the Criminal Code.
