Case of Contract Teacher Accused of Holding Multiple Positions Dropped by Prosecutors

The East Java High Prosecutor’s Office has officially dropped the case against Muhammad Misbahul Huda (MMH), a contract teacher at SDN Brabe 1 in Probolinggo, who was previously named a suspect for holding a second position as a Village Local Facilitator (PLD).

“On Friday, 20 February 2026, the suspect was released from the Kraksaan Detention Centre, and subsequently, the East Java High Prosecutor’s Office took over the case, and the investigation was halted,” said the Head of the Legal Information Centre at the Attorney General’s Office, Anang Supriatna, to reporters on Wednesday (25 February).

Anang revealed several reasons why the case against contract teacher MMH was dropped. One of the reasons was that the suspect did not benefit from the alleged offence.

“Based on the consideration and reasons that the act in question was unlawful in a negative sense. The state’s losses have been recovered amounting to Rp 118,861,000, the suspect did not benefit, public interests were served, and there was a cost-benefit consideration in handling the case,” he said.

He explained that PLDs, or village facilitators, are not allowed to hold other jobs that are paid for from state funds. He stated that the contract teacher was not aware of the details regarding the budget.

“So, the legal basis is this, the justification is this. So, the unlawful act did occur, but it was not a reprehensible act. For example, in this village fund, specifically for this village fund related to the facilitator, it is not allowed to hold a second position where the source of funds comes from the regional or national budget,” said Anang.

“Now, this village fund comes from the national budget, right? If he is a contract teacher, he is funded by the regional budget. So, he didn’t know, he was just looking for a side job. He was looking for a side job, he didn’t know, and there was a subject of the violation,” he added.

According to Anang, the violation occurred because the teacher included information from the school principal as if he were not a contract teacher paid by the regional budget.

However, Anang stated that the prosecution prioritised persuasive measures in this case.

“He violated it by including information from the school principal that he was not a contract teacher. It’s a pity, the benefit was not that much, right? We must be persuasive. We prioritise recovery. Yes, recovery,” he said.

“It’s done, it’s done as of today. Yes, confirm. It was dropped by the East Java High Prosecutor’s Office this morning,” Anang continued.

Previously, Misbahul was named a suspect after being accused of causing state losses of Rp 118 million by receiving a salary from two jobs, as a contract teacher and a village facilitator.

The designation as a suspect was made by the Probolinggo District Prosecutor’s Office. According to the prosecutors, the contract for village facilitators stipulated that Misbahul should not have any other employment relationship funded by state funds, such as the national budget, regional budget, or village budget.

Similar provisions were also said to apply in the contract for non-permanent teachers, which prohibit having an employment agreement with another institution if both are funded by state funds. The Head of the Intelligence Section of the Probolinggo Regency Prosecutor’s Office, Taufik Eko Purwanto, explained that the rules were outlined in the employment agreement for each position.

“The state losses incurred, based on calculations by the Audit Team of the East Java High Prosecutor’s Office, amounted to approximately Rp 118 million,” said Taufik on Thursday (12 February).
