Busyro Muqoddas and Others File Constitutional Challenge to 2026 State Budget Law Regarding MBG

Jakarta — Several institutions and individuals filed a judicial review against the 2026 State Budget Law (UU APBN 2026) at the Constitutional Court (MK) on Tuesday, 10 March 2026.

The constitutional challenge was submitted directly by the petitioners to the Constitutional Court. One of the petitioners is Busyro Muqoddas, former chairman of the Corruption Eradication Commission (KPK), together with various civil society representatives.

Busyro stated that the submission of this judicial review was motivated by concerns over the destructive impacts arising from the increasingly uncontrolled governance of the MBG programme.

“What prompted us to file this judicial review is the tragedy resulting from MBG programme management that is increasingly out of control. We have already felt a number of destructive impacts that have caused widespread suffering to society,” Busyro said at the Constitutional Court.

If left unchecked, he argued, the public—as holders of the highest sovereignty—would be the party most harmed.

Busyro also assessed that the impacts of the problem extend beyond the policy level and reach into fiscal matters.

“The destructive impacts are widespread, extending to fiscal issues,” he said.

In his view, the Constitutional Court is an institution born from the spirit of democracy and must be respected.

“We come here as a demonstration that we still maintain our commitment to democracy. We balance this with a civilised approach, namely through the Constitutional Court,” he said.

Busyro expressed hope that the constitutional judges could understand the background and public aspirations that motivated the filing of the judicial review.

“Our hope is that the Constitutional Court judges can hear the cry of public sentiment resulting from the tragedy of MBG programme governance,” he said.

Furthermore, the filing of this petition also represents civil society’s effort to maintain space for constructive criticism of state policy.

“If left unchecked, this country could deteriorate further. That is why we come here, filing this petition as an effort to bring a torch of justice to the broader public,” said Busyro.
